ORDINANCE NO. 43-
80 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE DELETING SECTIONS 9.16.
010,9.16.020, 9.16.040 AND 9.16.060 FROM
THE ORANGE MUNICIPAL CODE REGARDING
DRUNKEN-NESS AND DISORDERLY
CONDUCT.WHEREAS, the City Council of the City of Orange
takes cognizance of California Penal Code Sections 381 and
647 which provide for the prosectuion of disorderly
conduct,drunkenness and the inhalation of certain substances;
and WHEREAS, Sections 9.16.010, 9.16.020, 9.16.040
and 9.16.060 of the Orange Municipal Code may have been
pre-empted by California Penal Code Sections 647 and 381;
and WHEREAS, the City Council of the City of Orange
finds that California Penal Code Sections 647 and 381 cover
the crimes of drunkenness, disorderly conduct and the
inhalation of certain substances and that Sections 9.16.010, 9.16.
020,9.16.040 and 9.16.060 are therefore no longer
necessary.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE DOES ORDAIN AS
FOLLOWS:SECTION
I:Sections 9.16.010, 9.16.020, 9.16.040 and 9.16.060
are hereby deleted from the Orange Municipal
Code.SECTION
II:This ordinance shall be published once within
fifteen 15) days after its passage in the Orange City Ne~s,
a newspaper of general circulation, published and.c~
rculated in the City of Orange, and shall take effect thnty (
30)days from and after the date of its final
passage.ADOPTED this 24th day of June,
