AND AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING SECTION 17.26.
010 AND 17.26.020 OF THE ORANGE
MUNICIPAL CODE RELATING TO PLANT NURSERIES IN
THE R-
1-6 ZONE.
AMENDMENT NO. 6-
80 CITY OF ORANGE WHEREAS, the Planning commission heretofore
has held a duly advertised public hearing on
the hereinafter described amendment to the orange Municipal Code and has
recommended to the City Council, by Resolution No.
PC-41-80 approval thereof; and WHEREAS, a number
of residents approached the City Council indicating opposition to
a wholesale nursery which was proposed in
the vicinity of their homes, and WHEREAS, the present code relating
to plant nurseries in the R-1-6 zone permits
such uses with the
stipulation that retail sales are not allowed, and WHEREAS, the
City Council directed staff to study relevant code provisions and
to prepare an amendment to the Municipal
Code implementing the findings of the study, and WHEREAS,
the Planning Commission was directed
to hold public hearings on this amendment, and WHEREAS, no one
spoke in favor of, and one person questioned the scope of
protection that would be provided
to single family residents by said amendment, and WHEREAS, the
City Council has concluded that the herein described amendments offer
some improved level of protection to single family neighbors of
plant nursery
uses although such protection is admittedly incomplete protection.NOW, THEREFORE, THE
CITY COUNCIL OF
THE CITY
OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Subsection C of Section
17.26.010 of the orange Municipal
Code shall be revised to
read as follows:SECTION 17.26.010 C Growing of
trees and shrubs for purposes of propagation and culture
only, provided, however, that no buildings or structures other than storage
structure for tools with a maximum floor area of 200 square feet and with
a maximum height of ten feet shall be permitted. In
addition,
only wholesaling of plants shall be permit-ted.SUbsection E of Section 17.
26.020 shall be added to
SECTION 17.26.020 E
commercial nurseries requiring the use of structures or permitting
seasonal sales associated with national holidays together with
incidental buildings and structures for such seasonal sales and,
provided further, that no seasonal sale period shall exceed one
consecutive thirty-day period during a calendar year and
provided that at least one portable chemical toilet facility shall be
avail-able on the premises at all times during such
sales.SECTION
II.This ordinance shall be published once within fifteen (
15)days after its passage in the Orange City News, a newspaper
of general circulation, published and circulated in the City
of Orange, and shall take effect thirty (30) days from
and after the date of its final
passage.ADOPTED this 10th day of June 19.!!
