Iil': Y!!_~ENSEN CITY W;RK ORDINANCE NO. 30-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 16.08.030 (E) AND ADDING SECTION 17.92. 010 (El TO THE ORANGE MUNICIPAL CODE RELATING TO TITLE COMPANY VERIFICATION OF MAILING LISTS FOR TENTATIVE TRACT AND ZONE CHANGE APPLICATIONS.Amendment 4-80 CITY OF ORANGE WHEREAS, the Planning Commission heretofore has held a duly advertised public hearing on the hereinafter described amendment to the Orange Municipal Code and has recommended to the City Council, by Resolution No. PC-25-80, approval thereof; and WHEREAS, the City Council concurs with the Staff that there is an an inconsistency between the application requirements for conditional use permits and variances on the one hand, and zone changes and tentative tract maps on the other; and WHEREAS, the nature of this inconsistency concerns the requirement for a title company to prepare the list of property owners within a 300 foot radius of the applicant's property for conditional use permit and variance applications; and I I I WHEREAS, such title company verification is not presently required of applicants for a zone change or tentative tract map,yet both applications require a list of nearby property owners;and WHEREAS, the City Council concurs with the Staff that extending title company verification of property owners nearby the subject property in tentative tract and zone change applications would have the following advantages:1. Improve the administration regarding all types of applications by making requirements more uniform.2. Minimize the confusion that exists concerning different application requirements for different applications when they all have the same due process requirements.3. Improve the due process guarantee of hearings for tentative tract map and zone change applications.4. Minimize the chance that the City be named in a suit challenging the due process of a tentative tract map or zone change application hearing.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: ECTION I: section 16.08.030 of the Orange Municipal Code shall be amended to read as follows: section 16.08.030 E. The names and relative locations of adjoining subdivision and adjoining and abutting streets, as well as a list of all property owners within 300 feet of the exterior boundary lines of the property involved as certified by a title insurance company authorized to do business in Orange County, California. section 17.92.010 shall be added to the Orange Municipal Code to read as follows: section 17.92.010 E. Application for a zone change shall be in writing, signed by applicant before a Notary Public or the Planning Director, filed in the office of the City Planning Division upon forms provided by the City. Said application shall contain the following information: 1. The ground for approval of the application. 2. Legal description and address of the property involved. 3. All property owners within 300 feet of the exterior boundary lines of the property involved as certified by a title insurance company authorized to do business in Orange County, California. SECTION II: This ordinance shall be published once within fifteen (15) days after its passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange, and shall take effect thirty (30) days from and after the date of its final passage.
