ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ORANGE AMENDING SECTION 17.26.070 OF THE ORANGE
MUNICIPAL CODE RELATING TO REAR YARD SETBACKS.

W~EREAS, t~e Plan~ing Commission , heretofore has held a duly
advert~sed publ~c hear~ng on the here~nafter described amendment
to the Orange Municipal Code and has recommended to the City
council, by Resolution No. PC-24-80, approval
thereof; and WHEREAS, the City Council concurs with the Staff
that the existing rear yard setback provisions in the
Single Family Residential District are vague and
confusing; and WHEREAS, the City Council concurs with the
Staff that simplifying the wording and format of the single
family residential rear yard setback provision would ease the Staff's
ability to administer, and improve the public's understanding
of,
the provision.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE DOES ORDAIN
AS FOLLOWS:
SECTION I:Section 17.26.070 of the Orange Municipal Code
shall be amended to read
as follows:Section 17.26.070
Rear Yard A rear yard of not less than twenty (20) feet
shall be provided as measured from the closest portion of
the main building to the rear
property line.A. Extensions within ten (10) feet of the
rear property line are permitted
as follows:1. The structure is one story, or if two
stories, it abuts a street, alley, or
public
use.

I 3.The extension does not exceed
twenty-five percent 25%) of the area required in
conforming to the twenty (20) foot
rear setback standard.If the extension exceeds
the twenty-five percent 25%) of required rear yard
area, then a usable and contiguous area must
be provided elsewhere,on the lot not including any required
front or s~de yard ar~as. The size of
this usable and contiguous area must be equal to that in
exces~ of the twenty-five percent (25%)
allowable

B.Covered patios, unenclosed on at least two sides are
permitted extensions within ten (10) feet of the' rear
property line provided said patio, including any area
covered by extensions permitted under Subsections A
and C hereof, does not exceed forty percent (40%) of
the required rear yard area.
c. Detached garages and accessory structures may be
situated in the required rear yard area subject to the
provisions of Section 17.74.080 and provided such
structures do not exceed forty percent (40%) of the
required rear yard area, including any area covered
by extensions permitted under Subsections A and B
hereof.
SECTION II:
This ordinance shall be published once within fifteen (15)
days after its passage in the Orange City News, a newspaper of
general circulation, published and circulated in the City of
Orange, and shall take effect thirty (30) days from and after
the date of its final passage.
