Jen"-~i...tL_CJ_.~rk_ORDINANCE NO. 28- 80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 17.06.020 OF THE ORANGE MUNICIPAL CODE AND APPROVING THE RECLASSIFICATION OF PROPERTY SITUATED ON THE EAST SIDE OF BATAVIA STREET, SOUTH OF FLETCHER AVENUE.Pre- Zone Change 922 M- R BATAVIA ASSOCIATES RECITALS: WHEREAS, after report thereon by the Planning commission and after due public hearings as required by law, and after finding the faots as shown by Resolution No. 5184 adopted by the City Council, the City Council of the City of Orange has concluded that the following amendment to Section 17.06.020 of the Orange Municipal Code should be adopted; and WHEREAS, there now exists in the unincorporated territory of the County of Orange certain real property hereinafter described which is designated as County of Orange A-I District; and WHEREAS, the City of Orange desires that the property hereinafter described be classified as City of Orange A-I District upon completion of annexation proceedings incorporating the territory into the City of Orange.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I:The following described real property is hereby changed to City of Orange A-I District, said zoning to be effective upon annexation of said real property to the City of Orange. Said real property is more particularly described as follows:PARCEL 1:That portion of the land allotted to T. D. Mott and Ascension Sepulveda in Decree of Partition of the Rancho Santiago de Santa Ana, recorded in Book B of Judgments of the 17th Judicial District Court of California, in the County of Orange, state of California, described as follows:Beginning at the Southwest corner of the land conveyed to Alf Howard Barnes by deed recorded February 10, 1944 in BOOK 1230, Page 548 of Official records, said Southwest corner being in the centerline of the road conveyed to the County of Orange by deed recorded January 17, 1917 in Book 299,Page 131 of Deeds; thence Southerly 260.67 feet along said centerline to a point 315.34 feet from the Northwest corner of the land conveyed to Ervin H. Mann by deed recorded November 23, 1936 in Book 858, Page 122 thence Easterly to a point in the Easterly line of the land conveyed to Mamie Reavis by deed recorded March 19 1929 in Book 256, Page 5 of Official Records, 315.60 feet from the Northeast corner of the land conveyed to said Ervin H. Mann; thence Northerly 196.30 feet along the said Easterly line' thence South 890 57' 30" West 235.85 feet; thence North O~ 50' East 64.09 feet to the Southeast corner of the land conveyed to said Alf Howard Barnes; thence Westerly 287.53 feet along the Southerly line of the land conveyed to A1f Howard Barnes to the point of beginning; EXCEPT beginning at the Southwest corner of the land conveyed to A1f Howard Barnes by deed recorded February 10, 1944 in Book 1230, Page 548 of Official Records, said Southwest corner being on the centerline of the road conveyed to the County of Orange by deed recorded January 17, 1917 in Book 299, Page 131 of Deeds; thence Easterly 287.53 feet along the Southerly line of the land conveyed to Alf Howard Barnes to the Southeast corner thereof; thence South 00 50' West 155.57 feet; thence westerly to a point on the centerline of the said road conveyed to the County of Orange, distant thereon 156.22 feet southerly from the point of beginning; thence Northerly along the centerline of the said road conveyed to the County of Orange 156.22 feet to the point of beginning. PARCEL 2: Beginning at the Southwest corner of the land conveyed to Alf Howard Barnes by deed recorded February 10, 1944 in Book 1230, Page 548 of Official Records, said southwest corner being in the centerline of the road conveyed to the County of Orange by deed recorded January 17, 1917 in Book 299, Page 131 of Deeds; thence Easterly along the Southerly line of the land conveyed to Alf Howard Barnes 287.53 feet to the Southeast corner thereof; thence South 00 50' West 155.57 feet to a point; thence Westerly to a point in the centerline of the said road conveyed to the County of Orange, distant thereon 156.22 feet Southerly from the point of beginning; thence Northerly along the centerline of the said :-oad conve~ed.to the County of Orange, 156.22 feet to the po~nt of beg~nn~ng; EXCEPTING THEREFROM the Northerly 75.11 feet, said 75.11 feet being measured along the Westerly line thereof. SECTION II: This ordinance shall be published once within fifteen (15) days after its passage in the Orange City News~ a news~aper of general circulation, published and circulated ~n the c~ty of Orange, and shall take effect thirty (30) days from and after the date of its final passage.
