JENSEN, CITY CLERK ORDINANCE NO. 27-80 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE ORDAINING THAT IN THE C-l DISTRICT A CHURCH SHALL REQUIRE AN ISSUANCE OF A CONDITIONAL USE PERMIT BY THE PLANNING COMMISSION.WHEREAS, the City Council, civic groups and many individuals have long been interested in the economic revitalization of the business district surrounding the historic plaza area of the City; and WHEREAS, in 1979, the City Council appointed a committee,which has become known as the Olde Towne Steering Committee, to develop a comprehensive long-term plan for downtown commercial redevelopment and beautification to assist the Council in enacting such additional legislation as may be needed to aid redevelopment and revitalization; and WHEREAS, the Committee has nearly completed this plan; and WHEREAS, it is the City Council's understanding that recently a church has acquired additional property in the area to expand its religious program; and WHEREAS, California Government Code Section 65858 provides that the legislative body may adopt as an urgency measure an interim ordinance to prohibit any uses which may be in conflict with a contemplated zoning proposal which the legislative body,Planning Commission or Planning Department is considering or studying or intends to study within a reasonable time.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I:The City Council hereby ordains that in the C- l District a church shall be subject to the issuance of a conditional use permit by the planning Commission, as provided in sections 17.86.010 et seq. of the Orange Municipal Code. The term church" is hereby defined as a building, together with its accessory buildings and uses, where pe:sons regularlY,ass:mble for religious worship, and which build~ng, together w~th ~ts acc7ssory buildings and uses, is ~aintai~ed and c;: ontrolled by a rel~gious body organized to susta~n publ~ c worsh~ p.SECTION II:The facts constituting the urgency justifying the enactment of this ordinance are as follows:The City Council and many citizens have been concerned about the measures which could be enacted to assist the redevelopment and revitalization of the downtown area for a long time. In .1979, the City council appointed a committee with repre~entatives of business and institutions to develop a comprehens~ve lo~g-range plan for the area. The City Council is informed and bel~eves that a church has recently acquired additional property in the same area to expand its religious activities.The City Council is not now fully aware of the impact that this church's property acquisitions and possible uses may have upon the proposed commercial redevelopment of the area.
