AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ORANGE ADDING
SECTIONS 12.58.010 THROUGH 12.58.040
TO THE ORANGE MUNICIPAL CODE TO PROVIDE FOR THE
CLOSURE OR THE RESTRICTING OF USE OF
CITY STREETS BY THE DEPARTMENT OF PUBLIC WORKS FOR
THE PROTECTION OF THE PUBLIC AND THE PUBLIC
STREETS.WHEREAS, the City
Council of the City of Orange takes cognizance of the
hazards that could exist on public streets during storm damage
or construction or maintenance operations;and WHEREAS, the
California
Streets and Highways Code, sections 124 et seq.,
provides for closing or restricting use of State highways under such
hazardous circumstances; and WHEREAS, the City
Council of the City of Orange desires to provide as much
protection on the City streets as are provided for the State
highways.NOW, THEREFORE, THE
CITY COUNCIL OF THE CITY OF ORANGE DOES O~AIN AS
FOLLOWS:SECTION I:Chapter
12.58,
Sections 12.58.010 through 12.58.040, is hereby added to
the Orange Municipal Code to read as follows:Chapter 12.58
CLOSING OR RESTRICTING
USE OF CITY STREETS Section 12.58.
010 public works may close or restrict use of streets.The
Department of
Public Works may restrict the use of,or close, any
City street whenever the Department of Public Works considers such
restriction of use necessary:A. For the
protection of the public against hazard~us conditions existing on
such street for such perwd as the hazard exists.
B. For the
protection of such street from damage during storms or during
construction, improvement or maintenance operations thereon.Section
12.58.
020 Notice.To notify the
public that a City street is closed or its use restricted,
the Department of Public Works may:A. Erect suitable
barriers or obstructions upon such streets.B. Post
warnings
and notices of the condition of any such street.

C. Post signs for the direction of traffic upon it, or to
or upon any other street or detour open to the public
travel.
D. Place warning devices on such street.
E. Assign a flagman to warn, detour or direct traffic on
such street.
F. Adopt such other measures as determined to be necessary
to protect the traveling public.
Section 12.58.030 Enforcement.
The Police Department shall cooperate with the Department
of Public Works in the enforcement of the closing, or
restriction of use, of any City street.
Section 12.58.040 Violation--
Misdemeanor.Any person who willfully fails to observe any
sign,marker, warning, notice or direction, placed or given
under Section 12.58.020 of this code, is guilty of a
misdemeanor.SECTION
II:This ordinance shall be published once within fifteen (
15)days after its passage in the Orange City News, a newspaper
of general circulation, published and circulated in the City
of Orange, and shall take effect thirty (30) days from and
after the date of its final
passage.ADOPTED this 8th day of April,
