W') X:1 f. v __~ c~ E[_',:t'lL!_'..."!f:.!ls~:!j,L.(:ny. ..CI...EHK iF k r,: j:ORDINANCE NO. 20-80 I, i m' t: I I t, I r AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE ORDAINING THAT NO APPLICATIONS FOR THE CONVERSION OF MULTIPLE DWELLING UNITS TO RESIDENTIAL CONDOMINIUMS SHALL BE ACCEPTED FOR PROCESSING BY THE CITY OF ORANGE FOR A PERIOD OF 120 DAYS FROM THE DATE OF EXPIRATION OF ORDINANCE NO. 10- 80.WHEREAS, California Government Code Section 65858 provides that a legislative body to protect the public safety, health and welfare may adopt as an urgency measure an interim ordinance, to prohibit any uses which may be in conflict with a contemplated zoning proposal which the legislative body, Planning Commission or the Planning Department is considering or studying or intends to study wi thin a reasonable time; and WHEREAS, the City Council adopted as urgency measures Ordinances No. 56-79 and 10-80, which had the effect of prohibiting condominium conversions for a period of 120 days; and WHEREAS, Government Code Section 65858 provides that the City Council may extend an urgency measure for one year, if after a public hearing the legislative body determines that the publ ic interest would be protected thereby; and WHEREAS, a public hearing was duly held the 19th day of February, 1980, and the city Council has determined that the public safety, health and wel fare would be best protected if the moratorium on condominium conversions shall continue until the City of Orange enacts a revised condominium ordinance which incorporates provisions which shall more satisfactorily provide for the City' s housing needs.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:The City Council hereby ordains that no applications shall be accepted for the conversion to residential condominium units of any multiple dwelling units, whether they a:- e presently existing or for which construction has begun, for a pen.od of 120 days from the date of expiration of Ordinance No. 10-80.SECTION II:The facts constituting the urgency justifying the enactment of this ordinance are as follows:The City of Orange has been processing appli~ation~ for the conversion of multiple dwelling units to condomin~ ums w~th ever-increasing frequency. The City Council is not now fully aware of the significance of the impact of said conversions upon the PUbl~c safety, health and welfare and,. in particular, .on the hous~ng needs of the community. The c~ L..-II1II examine the adequacy of present City policies, practices, standards and local laws and to study reports presented by Staff and the lousing Element Review Committee. Further, the City Council desires sufficient time to enact any measures which may be necessary to protect the public safety, health and welfare, and to solve these housing needs.THEREFORE, pursuant to the provisions of section 65858 of the California Government Code and in order to protect the i public safety, health and welfare, the City hereby adopts this i interim ordinance as an urgency measure which shall be effective for a period of 120 days from the date of expiration of Ordinance I No. 10-80.
