JENSEN, CITY CLERK 1 I 1 1 J II ORDINANCENO. 12-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 9100.21 OF THE ORANGE tvXUNICIPAL CODE RELATING TO THE SALE OF FIREARMS OR AMMUNITION OR THE STORAGE OR USE OF FLAMMABLE SUaS~ANCES OR SALE, PREPARATION OR STORAGE OF FOOD PRODUCTS AS PART OF A HOME OCCUPATION. j I Iil) Am~ndmen'b.12 -7 9 C.ITXOFORl'iN,GIiJ WHEREAS, the Planning Commission heretofore has held a duly adver.tised public hearing on the 'hereinafter described amendment to the Orange Municipal Code,and') has~eo0mmended to the City Council, by Resolution No. PC-1l4-79, approval thereof; and I;"WHEREAS, the intent of the City Council to allow "home OCoup<ltion" as outlinedin~ection91(i)O.21w~s to limit such home occupations" to thosesecondary innat\:lr,e., to the primary use of a residence; and WHEREAS, it was the intent of the City council that such home occupations should. not interfere: with the quiet enjoyment of residences in the area surrounding "home occupations"; and WHEREAS, it was' the intent of the City Council that suchhome occup<ltions shQ.1ald not endanger residences nor citizens in the area surrounding "home occupations"; and WHEREAS, the City Council concurs with the Staff that the sale of firearms and ammu.nition froma..'xesidence as a "home occupation" is fraught with peril; and WHEREAS, the City Council concurs with the Staff that the potential dangers relating to fires or explosions in connection with the sale andstorag,e of firearms, ammunition, flammable substances or hazardous chemicals outweigh the possible benefits of allowing such use,s as a "home o, ccupation"; and WHEREAS, the City Council concurs with the Staff that there is the potential for serious problems regarding the accessibility of firearms and ammunitions to children and young people; and WHERIilAS, the, CityCouncil een<;lurs with the Staff that there isthe p!ii>tential for serious problems regarding the storage oruseoff;).1;!.l)lm<lble s1;1bstancesorbaZalidous cJael)lieals in relation to a home (l) C:)cupation."NOW., THEREFORE, THE CITY€OUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I:Section 9100.21 of the Orange Munieipal Code shall be amended to read as follows: i ADOPTED this 19th day of February 1980. jia t, _ ~.';rrt1!lJl Section 9100.21 Home Occupation"A home occupation is one carried on in the dwelling by the oecupant of that dwelling as a secondary Ul;!e, where there ~ re no disp~ays or signs at or upon the premises, no commod~ ty or serv~ces are sold upon the premises, no other non- occupants employed at that location, no storage of materials.and/or supplies upon those premises except within thedwall~ng or an enclosed garage. Any materials and/or supplies which are stored upon the premises shall be limited andsnall not occupy a space in excess of 2,000 cubic feet. Such an occupation shall not: 1. Create light, noise, odor, dust, vibration, fumes or smoke readily discernible at the exterior boundaries of the parcel. 2. Invol va the use of mechariie"Il.:l>egu!pment not recognized as a part of reasonable household use~ 3. Significantly increase the off-street parking load.4. Involve the storage or use of flam~able substances as defined by the Uniform Fire Code, Section 15.101 et seq., or hazardous chemicals as defined by the Uniform Fire Code, Section 19.101 et seg.5. Involve the sale of firearms or ammunition except to those persons set forth in California Penal Code Section 12078. Records shall be kept for a minimum of one year on the sales of firearms. Information on these records shall include:a. Date of purchase.b. Name, address, phone number, driver's license number and date of birth of the person buying any firearms.c. Brand name, model number, and serial number of firearm purchased.6. Involve the sale, preparation, or storage of food or food products.SECTION II:This ordinance shall be published once within fifteen ( 15)days after its passage in the orange.
