CITY c;y..~ yy~ ORDINANCE NO. 10- 80 f W t R i i 1 Iii 1 j I g! i I AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTED AS AN URGENCY MEASURE ORDAINING THAT NO APPLICATIONS FOR THE CONVERSION OF MULTIPLE DWELLING UNITS TO RESIDENTIAL CONDOMINIUMS SHALL BE ACCEPTED FOR PROCESSING BY THE CITY OF ORANGE FOR A PERIOD OF THIRTY DAYS IN ADDITION TO THE NINETY DAYS PROVIDED IN ORDINANCE NO. 56-79.WHEREAS, California Government Code Section 65858 provides that a legislative body to protect the public safety, health and welfare may adopt as an urgency measure an interim ordinance, to prohibit any uses which may be in conflict with a contemplated zoning proposal which the legislative body, Planning Commission or the Planning Department is considering or studying or intends to study within a reasonable time; and WHEREAS, an urgency measure adopted in accordance with Government Code Section 65858 may be effective for one hundred twenty days; and WHEREAS, the City Council adopted Ordinance No. 56- 79 as an u~ency measure on October 23, 1979, for a period of only ninety days; and WHEREAS, the additional thirty days allowed by law is now needed to extend the time for the City Council to decide upon the measures needed to protect the public interest or to provide time for the City Staff to advertise for a public hearing if the determination is made to consider an urgency ordinance to continue the present moratorium on the conversion of multiple dwelling units to condominiums for an additional period of one year. I II I I'I ii/'.I NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:The City Council hereby ordains that no applications shall be accepted for the conversion to residential condominium units of any multiple dwelling units, whether they are presently existing or for which construction has begun, for a period of thirty days from the date of expiration of Ordinance No. 56-79.SECTION II:The facts constituting the urgency justifying the enactment of this ordinance are as follows:The City of Orange has been processing applications for the conversion of multiple dwelling units to condominiums with ever-lncreasing frequency. The City Council is not now fully aware of the significance of the impact of said conversions upon the public safety health and welfare and, in particular, on the housing needs'of the community. The III- II' I'F,' i I,; M, I t examine the adequacy of present City policies, practices, standards and local laws and to study reports presented by Staff and the lousing Elem~m~ Revi7w Committee. Further, the City Council desires suffJ.c~ent tJ.me to enact any measures which may be necessary to protect the public safety, health and welfare, and to solve these housing needs. I I THEREFORE, pursuant to the prov~slons of section 65858 of the California Government Code and in order to protect the public safety, health and welfare, the City hereby adopts this interim ordinance as an urgency measure which shall be effective for a period of thirty days from the date of expiration of Ordinance No. 56- 79.ADOPTED this 15th day of January, 1980.c.
