ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ORANGE AMENDING SECTION 9113.2 (c) OF THE ORANGE
MUNICIPAL CODE RELATING TO SETBACKS ON CORNER
AND REVERSE CORNER LOTS.CITY
OF ORANGE WHEREAS,
the hereinafter described amendments to the Orange Municipal
Code were duly heard during an advertised public hearing
by the Planning Commission and recommended to the City council
for approval; and WHEREAS,
Section 9113.2 (c) concerning side yard setbacks on corner
and reverse corner lots is misplaced within the zoning ordinance
I and WHEREAS,
this provision is not readily accessible placed in the
General Provisions Section; and Section
9106.4 (c) (5) - Exceptions On all
corner and reverse corner lots, there shall be a side yard
on the street side of not less than ten feet.Other exceptions
are as provided in Sections 9113 and 9114.Section 9107.
5 (c) (6) - Exceptions On all corner
and reverse corner lots, there shall be a side yard on
the street side of not less than ten feet.Other exceptions are
as provided in Section 9113.2.WHEREAS, a more
workable organization would place these setback requirements in
the Development Standards Section of the respective zones that
these requirements regulate.NOW, THEREFORE, THE
CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:
SECTION I:The
Orange Municipal
Code is hereby amended to add the following provisions thereto:
Section 9105.4
Except as provided
in Sections 9113 and 9114 of this Code, each side
yard shall be not less than five feet wide,except on all
corner and reverse corner lots where there shall be a
side yard on the street side of not less than ten feet for any
main or accessory building, structure, or part thereof.
section 9107.13
Each side yard shall be not less than five feet wide on
interior yards and not less than ten feet wide on side yards
adjacent to a street and no required side yard setback in
the O-P District adjacent to a street shall be surfaced
nor used for parking purposes. No accessory building,
structure,or part thereof shall be established or located within
the required setback in the O-
P District.
SECTION II:The Orange Municipal Code is hereby amended to
delete the
following provision:Delete Section 9113.
2 (c)
SECTION III:This ordinance shall be published once within
fifteen (15)days after its passage in the Orange City News, a
newspaper of general circulation, published and circulated in the
City of Orange, and shall take effect thirty (30) days from
and after the date of its
final passage.ADOPTED this 22nd day of
