J. .1ENSEN, CITY CLERK m_''''~'''',.",..,..". v,_,__.""._~'~~.__n'"'~_'_".""__""__'~_'_~'"."._"~,.-Amendment 9- 79 ORDINANCE NO. 5-80 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 9107.5 (g) (2) c OF THE ORANGE MUNICIPAL CODE RELATING TO MINIMUM DISTANCE BETWEEN BUILDINGS IN THE MULTIPLE FAMILY ZONES. CITY OF ORANGE WHEREAS, the Planning commission heretofore has held a duly advertised public hearing on the hereinafter described amendment to the Orange Municipal Code and has recommended approval thereof; and WHEREAS, the current m~n~mum allowable distance between main buildings and non-dwelling accessory buildings in the RM- 7, 000,RM-7,000-A, and RMM-6, 000 Districts is eight feet; and WHEREAS, the minimum allowable distance between main buildings and non-dwelling accessory buildings in all residential zones,other than those specified above in this proposed change, is six feet; and I 1 Section 9107.5 (g) (2) c shall be amended to read as follows: Section 9107.5 (g) (2) c Minimum distance between main building and non-dwelling accessory building - six feet.WHEREAS, the City Council concurs with the findings of the Planning Staff and Planning Commission that there is no compelling Justification for both this inconsistency and the more stringent standard in the RM-7, 000, RM-7, OOO-A, and RMM-6, 000 Districts; and WHEREAS, the City Council concurs with the Staff and the Commission that the inconsistency noted in this report creates unnecessary confusion and impedes the planning process.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:SECTION II:This ordinance shall be published once within fifteen (15,)days after its passage in the orange City News~ a newspaper of general circulation, published and circulated ln the City of Orange, and shall take effect thirty (30) days from and after the date of its finalpassage.ADOPTED this 22nd day of Janua,,~Yl_ , 1980:'~J , C~ t,~~"--.lllayorhof theCity ofOrange Pro Tern ATTEST:i??~ (1 ," J. t!.,/ t.I':" / AYES: NOES: ABSTAINED: ABSENT: COUNCILMEN: COUNCILMEN: COUNCILMEN: COUNCILMEN: BARRERA, SMITH, I-IAYOR PRO TEM BElL"!
