HomeMy WebLinkAboutORD-15-92 Establish No Pedestrian Crossing Zones & Setting Violation FinesORDINANCE NO. 15- 92 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ESTABLISHING NO PEDESTRIAN CROSSING ZONES AND SETTING FINES FOR VIOLATIONS THEREOF.WHEREAS, the City Council has determined that a mechanism is necessary for protecting public safety regarding pedestrians crossing streets in addition to those provided for in the Vehicle Code as permitted by Vehicle Code section 21961; and WHEREAS, the Council has determined that such mechanism should apply to Collins Avenue from Tustin street to the easterly end of the bridge structure, but should be available to be used in other areas when the need is shown.NOW, THEREFORE, the City Council of the City of Orange ordains as follows:section I:The following chapter 10.59 is added to the Orange Municipal Code:Chapter 10. 59 NO PEDESTRIAN CROSSING ZONE sections:10.59. 010 10.59. 020 10.59. 030 No Pedestrian Crossing Zone Violation Misdemeanor Designated No Pedestrian Crossing Zones 10.59.010 - No Pedestrian Crossinq Zone. It shall be unlawful for any pedestrian to cross any public street at any time and/or place where a "No Pedestrian Crossing Zone" has been established by resolution or ordinance of the City Council. Each such Zone shall be delineated by signs placed at each end of the designated zone of not less than 12" x 18" inches, containing the words "No Pedestrian Crossing" and the international symbol for no pedes- trian crossing prominently displayed thereon, posted at each end of the designated zone, with an arrow pointing to the opposite end of the zone. If the designated zone is more than 200 feet from end to end, then additional signs, showing arrows pointing in both directions, shall be placed between the two border signs at intervals of not less than 100 feet and not more than 200 feet or such alternative signage shall be posted as shall be approved by the City Traffic Engineer based upon the particular charac- teristics of the designated area. Except as specified in this section, the size, shape, height, color and design of the signs or the letters and arrows appearing on the signs and the content of the wording of each sign shall be as determined by the city Traffic Engineer. Each sign shall contain reference to this Chapter. 10.59.020 - Violation Misdemeanor. Any person violating any provision of this Chapter or failing to obey any signs posted under this chapter shall be guilty of a misdemeanor and shall be subject to a fine of not less than $25 for a first offense and not less than $50 for each subsequent offense within 12 months of any prior offense, or such other fine as the City Council may set by resolution from time to time.10. 59.030 - Desianated No Pedestrian Crossina Zones. No Pedestrian crossing Zones are hereby established at the following locations:A. Collins Avenue from the crosswalk at Tustin street to the easterly terminus of the bridge structure crossing the 55 Freeway.SECTION II: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The city Clerk shall post in the Office of the city Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
