UNIFORM CODE FOR ABATEMENT OF DANGEROUS
BUILDINGS WITH CERTAIN AMENDMENTS; AMENDING
CHAPTER 15.24 OF THE ORANGE MUNICIPAL CODE
BY ADOPTING THE 1990 EDITION OF THE
NATIONAL ELECTRICAL CODE WITH CERTAIN
AMENDMENTS.WHEREAS, after a public hearing on June 16, 1992, the city Council determined
to adopt the editions of the various Uniform Codes with amendments recommended by
staff.NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ORANGE AS
FOLLOWS:Section
I:Chapter 15.04 of the Orange Municipal Code is amended to read as

Section 15.04.010 Adopted by Reference. The City Council adopts by reference the
Uniform Building Code, 1991 Edition, copyright 1991 by the International Conference of
Building Officials, and said Uniform Building Code is adopted in total as the law of the city
except as provided for in this chapter. One copy of the Code has been and is now filed with
the office of the City Clerk, and said Code is adopted by reference as if incorporated and set
out at length in this chapter.
Section 15.04.020 Fee Schedule. The Uniform Building Code, 1991 Edition is
amended by deleting Table No. 3,A Building Permit Fees, Table 70,A Grading Plan Review
Fees, Table 70,B Grading Permit Fees, and by providing that fees shall be established by
Resolution of the City Council.
Section 15.04.030 Chapter 38 Fire Extinguishine. Systems. For the purpose of this
chapter, the Fire Marshal shall be responsible for plan review, permit issuance, fee collection
and inspection of fire suppression systems such as fire sprinklers, fixed systems installed in
grease hoods and halon systems and detection systems which sense smoke, fire, heat or
products of combustion.
Section 15.04.040 Section 7005 Amended. The following subsection, "Building
Official", is added to section 7005. "Building Official: For the purpose of this chapter only,
the Building Official shall mean the City Engineer or their designated representative."
Section 15.04.050 Imposition of Stricter Standards. Whenever Chapter 15.32,
Uniform Fire Code Section 15.32.010 et seq., imposes stricter standards than imposed by this
code, Chapter 15.32, Uniform Fire Code, is to govern,
Section 15.04.060 Violations and Penalties:
A. It shall be unlawful for any person, firm, or corporation to erect, construct.
enlarge, alter, repair, move, improve, convert or demolish, equip, use, occupy or maintain

any building or structure in the City, or cause the same to be done or to perform or maintain
any grading work or cause the same to be done, contrary to, or in violation of, any of the
provisions of this chapter.
B. Any person, firm, or corporation violating any of the provisions of this chapter
shall be deemed guilty of a separate offense for each and every day or portion thereof during
which any violation of any of the provisions of this chapter is committed, continued, or
permitted, and each such offense shall be punishable by a fine of not more than One Thousand
Dollars ($1000.00), or by imprisonment for not more than six months, or both such fine and
imprisonment.
C. In addition, this code may be enforced by injunction or by other appropriate civil
remedy.
Section II:
The Orange Municipal Code is hereby amended by revising Chapter 15.08 in its
entirety to read as follows:

Section 15.08.010 Adopted by Reference. The City Counsel adopts by reference the
Uniform Housing Code, 1991 Edition, Copyright 1991 by the International Conference of
Building Officials, and said Uniform Housing Code is adopted in total as the law of the City
except as provided by this Chapter. One copy of the code has been and now is filed in the
office of the City Clerk, and the code is adopted by reference as if incorporated and set out in
length in this chapter.
Section 15.08.020 Section 7005 Amended. The following subsection, "Building
Official", is added to Section 7005. "Building Official: For the purpose of this chapter only,
the Building Official shall mean the Manager of Code Enforcement Services or their
designated representative."
Section 15.08.030 Violations and Penalties. A. Any person, firm, or corporation
violating any of the provisions of this chapter shall be deemed guilty of a separate offense for
each and every day or portion thereof during which any violation of and of the provisions of

this chapter is committed, continued, or permitted, and each such offense shall be punishable
by a fine of not more than One Thousand Dollars ($1000.00), or by imprisonment for not
more than six months, or both such fine and imprisonment.
B. In addition, this code may be enforced by injunction or by other appropriate civil
remedy.
Section III:

entirety to read as follows:

Section 15.12.020 Fee Schedule. The Uniform Mechanical Code, 1991 Edition is
amended by deleting section 304 (a) and (e) and by providing that fees for the issuance of
mechanical permits, for checking of mechanical plans and for fees for the investigation of
work done without permits shall be as established by resolution of the City Council.
Section 15.12.030 Violations and Penalties. A. Any person, firm, or corporation
violating any of the provisions of this Chapter shall be deemed guilty of a separate offense for
each and every day or portion thereof during which any violation of any of the provisions of
this Chapter is committed, continued, or permitted, and each such offense shall be punishable
by a fine of not more than One Thousand Dollars ($1000.00), or by imprisonment for not
more than six months, or both such fine and imprisonment.
B. In addition, this code may be enforced by injunction or by other appropriate civil
remedy.

Section 15.16.010 Adopted by Reference. The City Council adopts by reference the
Uniform Plumbing Code, 1991 Edition, copyright 1991 by the International Association of
Plumbing and Mechanical Officials, and said Uniform Plumbing Code is adopted by reference
as is incorporated and set out at length in this Chapter. One copy of the Code has been and
now is filed in the office of the City Clerk and the code is adopted by reference as if
incorporated and set out at length in this Chapter.
Section 15.16.020 Fee Schedule. The Uniform Plumbing Code, 1991 Edition, is
amended by deleting the schedule of fees contained section 20.7 and by providing that fees
shall be established by the City Council
Section 15.16.030 Definitions. The Uniform Plumbing Code, 1991 is amended by
adding Section 117 and Section 120 as follows:
Plumbing Contractor - a plumbing contractor is a person who may conduct, carry-on or
engage in the business of plumbing and is so licensed pursuant to the Business and Professions
Code of the State of California.
Sewer Disposal Contractor - a sewer or sewage disposal contractor is a person who may conduct, carry-on or engage in the business of installing, altering or repairing sewers and
private sewage disposal systems and is so licensed pursuant to the business and Professions
Code of the State of California.

Section 15.16.040 State Contractor's License. The Uniform Plumbing Code, 1991
Edition, is amended by adding section 20.15 as follows: 20.15: Nothing contained in this
code shall be deemed to require registration of any person holding a valid State Contractor's
License issued by the State of California. Permits as required by this code may be issued to
applicants possessing a valid state contractor's license issued by the State of California, when
such license includes within its classification limitations, the activities set forth on the
application for permit and entitles the licensee to perform personally or through employees
qualified and registered as required by this code, all such activities without further
qualification or registration.
Section 15.16.050 Violations and Penalties. A. Any person, firm, or corporation
violating any of the provisions of this Chapter shall be deemed guilty of a separate offense for
each and every day or portion thereof during which any violation any of the provisions of this
chapter is committed, continued,or permitted, and each such offense shall be punishable by a
fine of not more than One Thousand Dollars ($1000.00), or by imprisonment for not more
than six months, or both such fine and imprisonment.
B. In addition, this code may be enforced by injunction or by other appropriate civil
remedy.
Section V:
The Orange Municipal Code is hereby amended by revlslOg Chapter 15.20 10 its
entirety to read as follows:

UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS

Section 15.20.010 Adopted by Reference. The City adopts by reference the Uniform
Code for Abatement of Dangerous Buildings, 1991 Edition, copyright 1991 by the
International Conference of Building Officials, and said code is adopted in total as the law of
the city except as provided in this Chapter. One copy of the code has been and now is filed in
the with the Office of the City Clerk, and said Code is adopted by reference as if incorporated
and set out at length in this chapter.
Section 15.20.020 Violations and Penalties. A. Any person, firm or corporation
violating any of the provisions of this Chapter shall be deemed guilty of a separate offense for

each and every day or portion thereof during which any violations of any of the provisions of
this Chapter is committed, continued, or permitted, and each such offense shall be punishable
by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not
more than six months, or both such fine and imprisonment.
B. In addition, this Code may be enforced by injunction or by other appropriate civil
remedy.
Section VI:
The Orange Municipal Code is hereby amended by revising Chapter 15.24 10 its
entirety to read as follows:

Section 15.24.010 Adopted by Reference: The City adopts by reference the National
Electrical Code, 1990 Edition, entitled "National Electrical Code" published by the national
Fire Protection Association, (NFPA), and including the "uniform Administrative Provisions
for the National Electrical Code", 1990 Edition published by the International Conference of
Building Officials, pages 1-11, and 70- I to 70-740 inclusive, and said code is adopted
in total as the law of the City except as proved for in this Chapter. One copy of the Code
has been and now is filed in the office of the City Clerk, and said Code is adopted by reference
as if incorporated and set out at length in
this Chapter.Section 15.24.020 Fee Schedule. The National Electrical Code, 1990
Edition, is amended by deleting the schedule of fees contained in Table 3-A and by
providing that fees shall be established by resolution of
the City Council.Section 15.24.030 Violations and Penalties. A. Any person,
firm, or corporation violating any of the provisions of this Chapter shall be deemed guilty of a
separate offense for each and every day or portion thereof during which any violations of any of

Section VII:
If any section, subsection, sentence, clause, phrase, part or portion of this Ordinanceisforanyreasonheldtobeinvalidorunconstitutionalbyanycourtofcompetentjurisdiction,such decision shall not affect the validi ty of the remaining portions of this Ordinance. TheCityCouncildeclaresitwouldhaveadoptedthisOrdinanceandeachsection, subsection,
sentence, clause, phrase, part or portion thereof, irrespective of the fact that anyone or moresections, subsections, sentences, clauses, phrases, parts or portions be declared invalid orunconstitutional.
Section VIII:
A summary of this Ordinance shall be published and a certified copy of the full text ofthisOrdinanceshallbepostedintheOfficeoftheCityClerkatleastfive (5) days prior to theCityCouncilmeetingatwhichthisOrdinanceistobeadopted. A summary of this Ordinanceshallalsobepublishedoncewithinfifteen (15) days after this Ordinance's passage in theOrangeCityNews, a newspaper of general circulation, published, and circulated in the City ofOrange. The City Clerk shall post in the Office of the City Clerk a certified copy of the fulltextofsuchadoptedOrdinancealongwiththenamesofthoseCityCouncilmembersvotingforanagainsttheOrdinanceinaccordancewithGovernmentCodeSection36933. ThisOrdinanceshalltakeeffectthirty (30) days from and after the date of its final passage.
