No. 17-19 Prohibit Hazardous Waste without PermitORDXNANCB NO. 20- 91 AN ORDXNANCB 01' THE CXTY COUHCXL 01'THB CXTY 01' ORANGB ADOPTBD AS All URGBNCY MBASURB BXTBHDXIITG XIITTBRXJI ORDXIlTAllTCB lITO. 17-91 PROBXBXTXIITG HAZARDOUS WASTB TRBATJlBIITT AIITD STORAGB I'ACXLXTXBS WXTHOUT A COHDXTXOHAL USB PERJlXT.WHEREAS, the City Council of the City of Orange has commissioned a study to develop appropriate criteria for the development of land uses involving the treatment, storage, and handling of hazardous waste as defined and controlled under the state of California's Tanner Act; and WHEREAS, the issue of hazardous waste is a cause of deep concern to the City Council and the residents of the City; and WHEREAS, the city Council previously found that unless a restriction is placed upon the development of new facilities for such treatment, storage and handling of hazardous waste during the pendency of such study, pending and or expected applications to develop such facilities would result in severe adverse environmental impacts that could not be properly mitigated by compliance with then current standards, pose a serious risk of life and health endangering releases of hazardous and toxic substances, and otherwise endanger the lives and safety of workers and residents and thereby result in a serious threat to public health, safety and welfare.WHEREAS, the City Council based on such findings did adopt Ordinance No. 17-91, an interim ordinance as an urgency measure pursuant to Government Code section 65858; and WHEREAS, the City council hereby finds that an extension of Ordinance No. 17-91 for a period of 10 months and 15 days pursuant to Government Code section 65858 is necessary in order to continue to prevent a current and immediate threat to public health, safety and welfare; and that the approval of development permits of any kind for any use prohibited or restricted by Ordinance No. 17-91 except as set forth therein would likewise result in a threat to public health, safety and welfare.NOW, THEREFORE, the City Council of the city of Orange does ordain as follows:SECTION 1:Ordinance No. 17-91 is hereby extended for a period of 10 months and 15 days from itscurrently scheduled date Section II: A summary of this Ordinance shall be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published and circulated in the City of Orange. The City Clerk shall post in the Office of the city Clerk a certified copy of the full text of such adopted Ordinance along with the names of those city Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect immediately and shall be of no further force and effect 10 months and 15 days from the date that Ordinance No. 17-91 would expire absent this Ordinance unless further extended pursuant to Government Code section 65858.Adopted this 16th day of Julv 1991.
