HomeMy WebLinkAboutORD-16-91 Prohibit Public Street Parking Without Permit During Designated HoursORDINANCE NO. 16- 91 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE PROHIBITING PARKING ON DESIGNATED PORTIONS OF CERTAIN PUBLIC STREETS DURING THE HOURS OF 10:00 P. M.TO 6:00 A.M. WITHOUT A VALID PARKING PERMIT WHEREAS, the City Council finds that restricting parking on certain public streets between the hours of 10 p.m. and 6 a. m.is a suitable and acceptable method of reducing parking overcrowding and criminal activity in certain residential neighborhoods impacted by one or both of these problems, and WHEREAS, it is in the best interests of the City and its citizens to avoid the concentration of these problems in a small number of such residential neighborhoods, and WHEREAS, such concentration degrades neighborhoods,increases demand for police and other city services and aggravates the total effect of such problems by reducing police and resident control over neighborhood problems and mutually reinforcing such negative influences by its commonality in the neighborhood.NOW THEREFORE, the City Council of the City of Orange does ordain as follows:section 1.A new section 10.30.050 is hereby added to the Orange Municipal Code to read as follows:section 10.30.050 Permit Parkinq Between Hours of 10: 00 p.m. and 6:00 a.m. A.(l) No person shall park or allow a motor vehicle to remain standing between the hours of 10: 00 p.m. and 6:00 a.m. on those portions of public streets designated in subsection B of this section 10.30.050, unless a valid parking permit is affixed to the left rear area of the bumper or such other area of the vehicle as the City Council may authorize, when signs have been posted giving notice thereof. A valid parking permit shall be required to park any motor vehicle on stated portions of any public street designated in subsection B below.A.(2) Any restricted parking areas designated in subsection B below shall be considered part of the Neighborhood Permit Parking Program established in section 10.30.040 for purposes of administration,shall be designated in such a way as to avoid confusion with any area designated in said section 10.30.040, and shall be subject to the provisions of subsections A(2) and D of said section 10.30. 040.B. The areas subject to permit parking restrictions from 10: 00 p.m. to 6:00 a.m. pursuant to this section are designated as follows: AREA F 1. The east side of Prospect street between Almond Avenue and Palmyra Avenue. 2. Both sides of Violet Lane, Shasta Street and Dunas street between Almond Avenue and Palmyra Avenue. 3. Both sides of Kathleen Street between Chapman Avenue and Palmyra Avenue. 4. The north side of Palmyra Avenue between craig street and Dunas street. 5. The south side of Palmyra Avenue between Craig street and Prospect street. AREAG 1. Both sides of Swidler Street between spring Avenue and Walnut Avenue. 2. Both sides of Palm Avenue and Sycamore Avenue between Swidler street and Seranado street. 3. Both sides of Euclid Avenue between James street and Seranado street. 4. Both sides of Silverleaf Avenue between Thomas Street and Seranado street. 5. Both sides of Seranado street between spring street and Walnut Avenue. 6. Both sides of James Street between sycamore Avenue and Euclid Avenue. 7. Both sides of Thomas Street between Sycamore Avenue and Silverleaf Avenue. 8. The north side of spring Street between Swidler Street and Seranado street. 9. The south side of Walnut Avenue between Swidler Street and Seranado street. section II. Leqal Construction. The provisions of this ordinance shall be construed as reasonably necessary to effectively carry out its purposes, which are hereby found and declared to be in furtherance of the public health, safety, welfare, convenience and enjoyment. Section III. Severabilitv. Should any sentence, section, clause, part or prov1s1on of this ordinance be declared invalid, the same shall not affect the validity of the ordinance as a whole or any other part thereof. Section IV. A summary of this ordinance shall be published and a certified copy of the full text of this ordinance shall be posted in the office of the Ord No. 16-91 A summary of this ordinance shall be published and a certified copy of the full text of this ordinance shall be posted in the office of the City Clerk at least five (5) days prior to the city council meeting at which this ordinance is to be adopted. A summary of this ordinance shall also be published once within fifteen (15) days after this ordinance's passage in the Orange city News, a news- paper of general circulation published and circulated in the city of Orange. The city Clerk shall post in the office of the city Clerk a certified copy of the full text of such adopted ordinance along with the names of those City council members voting for and against the ordinance in accordance with Government Code section 36933. This ordinance shall take effect thirty (30) days from and after the date of its final passage.
