91 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE REPEALING AND
DELETING CHAPTER 8.12 AND SECTION 15.32.130
OF THE ORANGE MUNICIPAL CODE AND
ADDING SECTION 15.32.130 PROHIBITING
THE MANUFACTURE, SALE AND USE OF
STATE SAFETY APPROVED
FIREWORKS.WHEREAS, in Resolution No. 7701, adopted on November
20,1990, the City Clerk declared the result of the General
Election held on November 6, 1990, concerning Measure L. That measure
was as
follows:Shall an Ordinance be adopted
prohibiting the existing sale of State safety
approved fireworks by non-profit organizations
in the City
of Orange?WHEREAS, pursuant to Resolution No. 7701, the
City Clerk certified that the number of votes cast for and against
Measure L were
the following:15,
727 Yes 15,
247 No WHEREAS, that as certified in Resolution No.
7701, the highest number of qualified voters voting on Measure L
relating to the prohibition of State approved safe and sane
fireworks within the City of Orange did vote in favor of it and
that the proposition shall be carried through in
this Ordinance.NOW, THEREFORE, the City Council of the City of
Orange does hereby ordain
as follows:
section I:Chapter 8.12 of the Orange Municipal Code is
hereby repealed.
Section II:Section 15.32.130 entitled Article 78--
Fireworks of the Orange Municipal Code
is hereby
repealed.section III:section 15.32.130 is hereby added to
the Orange Municipal Code to
read as follows:15.32.130 Fireworks Prohibited. The
manufacture, sale, or use of State approved safe and sane fireworks
as currently defined or thereafter amended by State statute is prohibited
in the City of Orange except as provided for and authorized
by the Uniform Fire Code as currently adopted and hereafter amended
in the
section IV:
A summary of this Ordinance shall be published and a
certified copy of the full text of this Ordinance shall be posted
in the Office of the City Clerk at least five days prior to the
city Council meeting at which this Ordinance is to be adopted. A
summary of this Ordinance shall also be published once within
fifteen (15) days after this Ordinance's passage in the Orange
city News, a newspaper of general circulation, published, and
circulated in the City of Orange. The City Clerk shall post in
the Office of the City Clerk a certified copy of the full text of
such adopted Ordinance along with the names of those City Council
members voting for and against the Ordinance in accordance with
Government Code section 36933. This Ordinance shall take effect
thirty (30) days from and after the date of its final passage.
ADOPTED this 19th day of February 1991.
