91 AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ORANGE AMENDING
CHAPTERS 17.04, 17.42, 17.43 AND 17.72 OF
THE ORANGE MUNICIPAL CODE TO ADD
REGULA-TIONS FOR THE PLACEMENT OF
CELLULAR
ANTENNAS.ORDINANCE AMENDMENT
3-90 CITY
OF ORANGE WHEREAS, on May 7, 1990, the Planning
commission adopted Resolution No. PC-36-90 for
Ordinance Amendment 3-90, which recommended to the City Council that Chapters 17.
04, 17.42, 17.43 and 17.72 of the Orange Municipal Code
be amended to add provisions to regulate the
placement of cellular antennas; and WHEREAS, on August 14, 1990, the
City Council concurred in the recommendation of the
Planning commission and
approved Ordinance Amendment 3-90; and WHEREAS, Ordinance No. 1-
91 will amend portions of the Orange Municipal
Code in accordance with Ordinance Amendment 3-90.NOW, THEREFORE, the
City Council of
the city
of Orange does ordain as follows:Section I:Title 17 of
the
Orange Municipal Code shall be amended as follows:A. Amend
Chapter 17.04, "Definitions" to add the following definition to Section
17.4.040 before the definition of "Coastal High Hazard
Area - FP Zone", to read as follows:Cellular Antennas.
Cellular Antenna is any radio or microwave repeating structure
used for the receiving
and transmission of waves for cellular phones.B. Amend Chapter
17.42, "C-1 Limited Business District", to add the
following regulations to Section 17.42.030. "Uses
Permitted", after subsection "H", to read as
follows:I. Cellular Antennas subject to the following:Ground
Mounted Antennas shall be located at least 100 feet
from any residentially zoned property, shall not exceed 65 feet in
height and shall conform to all building setback
requirements. All equipment associated with the operation of a
ground mounted cellular antenna shall comply with develop-ment standards
Building Mounted Antennas - Antenna elements located on top
of buildings shall not exceed 10 feet in height, and the combined
height of the building and antenna shall not exceed the
height limitations of the underlying zone or building approval.
Support and/or switching equipment shall be located inside
the building.All
applications for building mounted antennas will require
administrative review by planning staff prior to issuance
of building permits. Planning staff will review antennas
for visual impact, affect on surrounding land uses,and
potential safety hazards.C.
Amend Chapter 17.43, "C-TR Limited Business District,
Tustin Redevelopment Project Area", to add the following regula-
tions to section 17.43.020, "Uses Permitted", after subsection "G",
to read as follows:
H. Cellular Antennas subject to the following:
Ground Mounted Antennas shall be located at lease 100
feet from any residentially zoned property, shall not exceed
65 feet in height and shall conform to all building setback
requirements. All equipment associated with the operation of
a ground mounted cellular antenna shall couple with develop-

of buildings shall not exceed 10' in height, and the combined
height of the building and antenna shall not exceed the

following regulations to section 17.46.03, "Uses Permitted", after
Subsection "E", to read as follows:

requirements. All equipment associated with the operation of
a ground mounted cellular antenna shall comply with develop-

to add a phrase to section 17.72.010.

Said section shall read in
17.72.010 Greater Heiqht Permitted When. Towers, spires,
penthouses, scenery lofts, cupolas, water tanks, silos, artificial
windbreaks, windmills, freestanding or ground mounted cellular
phone antennas, tower antennas and similar structures and necessary
mechanical appurtenances may be built and used to a greater height
than the limit established for the district in which such
structures are located; provided, however, that no structure in
excess of the allowable building height shall be used for sleeping
or eating quarters or for any commercial purpose other than such as
may be incidental to the permitted uses of the main building.
section II.
A summary of this Ordinance shall be published and a certified
copy of the full text of this Ordinance shall be posted in the
Office of the City Clerk at least five (5) days prior to the City
Council meeting at which this Ordinance is to be adopted. A sum-
mary of this Ordinance shall also be published once within fifteen
15) days after this Ordinance's passage in the Orange city News, a
newspaper of general circulation, published, and circulated in the
city of Orange. The city Clerk shall post in the Office of the
City Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting
for and against the Ordinance in accordance with Government Code
section 36933. This Ordinance shall take effect thirty (30) days
from and after the date of its final passage.
