92 AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ORANGE
ESTABLISHING A PRIVATE PARKING VEHICLE IMPOUND
FEE.WHEREAS, state law mandates that tow companies
notify local police departments of any and all private
property vehicle impounds;
and WHEREAS, state law mandates that local law
enforcement agencies accept and record this information and for
the public benefit recommend that the information be placed
into the state Department of Justice stolen vehicle system;
and WHEREAS, each such notification results in
the expenditure of city funds in the minimum amount of $4.00
to pay for labor and administrative costs resulting from
these state mandates none of which is paid for by the state;
and WHEREAS, the City council of the city of Orange
has determined that it is just and reasonable that the owner
of the vehicle so impounded be required to pay a fee to
offset the cost to the city of processing the notification for
his
vehicle.NOW, THEREFORE, the City council of the city of
Orange does ordain as
follows:section
I:A new Chapter 10.43 is hereby added to the
Orange Municipal Code to read as
follows:Chapter 10.

Penalties 10.43.010 - Private Propertv Vehicle Impound Fee. - The owner,
or other person responsible for, any vehicle impounded
by any tow company from private property in the city
of Orange under the California Vehicle Code shall pay in
accordance with the provisions of this Chapter a fee in the
amount of $5.00, or such other amount as the City Council
may establish from time to time by resolution, for the
processing and recordation of notices of the impound of such
person's vehicle. Such fee shall be collected by the tow
company impounding the vehicle at the time of collection of
its own towing and/or impound fees and shall be paid over to
the City each month within 10 days after the close of the
calendar month for which payment is due. Each towing
company shall provide to the City, on a monthly basis
concurrently with its monthly payment, a summary report of
all such impounds and fees collected in such form and/or
detail as the Chief of Police may specify from time to time,
and shall make available to the City upon request any and
all records of the information necessary to verify such
report upon the request of the City.
10.43.020 - Penalties. Any person violating any provisions of
this Chapter shall be guilty of a misdemeanor and shall be
punishable therefor by a fine of not more than $500 or by imprisonment
in the county jail for not more than six (6)months
or by both such fine and imprisonment.section
II:A
summary of this Ordinance shall be published and a certified
copy of the full text of this Ordinance shall be posted
in the Office of the City Clerk at least five (5)days
prior to the City Council meeting at which this Ordinance
is to be adopted. A summary of this Ordinance shall
also be published once within fifteen (15) days after this
Ordinance's passage in a newspaper of general circulation,
published, and circulated in the City of Orange.
The city Clerk shall post in the Office of the city Clerk
a certified copy of the full text of such adopted Ordinance
along with the names of those City Council members voting
for and against the Ordinance in accordance with Government
Code section 36933. This Ordinance shall take effect
thirty (30) days from and after the date of its final passage.
