93 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING SECTION 5.16.
030 OF THE ORANGE MUNICIPAL CODE TO
INCREASE THE UNIFORM TRANSIENT OCCUPANCY
TAX FROM 8% TO
10%.WHEREAS, the City Council finds that it is in the
best interest of the city of Orange to increase revenues
collected through the Uniform Transient Occupancy Tax which assists
in paying for municipal services provided to non-residents
of the City while temporarily staying at hotels, motels,
and other places of transient occupancy in the
city; and WHEREAS, the city Council finds that an increase
in the transient occupancy tax from 8% to 10% will not place
an undo burden on businesses in the city, nor apply to residents
of the City, but be collected from non-resident
temporary occupants of
public accommodations; and WHEREAS, the City Council finds that
all notices hearings and other procedures required by state law
and local ordinance have been complied with for the increase
of said Uniform Transient
Occupancy Tax; and NOW, THEREFORE, the City Council of the City
of Orange does hereby
ordain as
follows:Section I:The first sentence of Section 5.16.030
of the orange Municipal Code is hereby amended to
read as follows:For the privilege of occupancy in any
hotel, each transient is subject to and shall pay a tax in the amount
of ten percent 10%) of the rent charged
by the operator."In all other respects said Chapter 5.
16 shall remain unmodified and in full
force and
effect.Section II:A summary of this Ordinance shall be
published and a certified copy of the full text of this Ordinance
shall be posted in the Office of the City Clerk at least five (5)
days prior to the City Council meeting at which this Ordinance
is to be adopted. A summary of this Ordinance shall
also be published once within fifteen (15) days after this Ordinance's
passage in a newspaper of general circulation, published,
and circulated in the City of Orange. The City Clerk shall post in
the Office of the city Clerk a certified copy of the full text
of such adopted Ordinance along with the names of those
City Council members voting for and against the Ordinance
in accordance with Government Code Section 36933. This Ordinance
thirty (30) days from and after the date of its final passage.
