94 AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ORANGE
ADDING SECTIONS TO VARIOUS CHAPTERS
OF TITLE 17 OF THE ORANGE MUNICIPAL
CODE PERTAINING TO AFFORDABLE
HOUSING.WHEREAS, the City Council of the City of Orange has adopted an
Affordable Housing Plan (the "Plan") as a supplement to the City's Housing Element;
and WHEREAS, the City Council desires to add a reference to the Plan in
the residential code sections of the Zoning Ordinance that will serve to inform developers
of the Plan and, specifically, of the 20% goal established for producing affordable
housing;
and WHEREAS, in addition, reference in the Zoning Ordinance will advise
the building community of the availability of incentives that may assist to offset the
costs incurred when developing units to be rented or sold at affordable or below market
rates.NOW, THEREFORE, the City Council of the City of Orange does ordain
as
follows:SECTION
I:Sections 17.26.020, 17.32.020, 17.34.020, 17.66.020 and 17.67.025 are added
to the appropriate chapters of Title 17 of the Orange Municipal Code to read as
follows:New Residential Development. The City Council has adopted a policy
that establishes a target goal of allocating 20% of the aunual production of
new residential housing as affordable to very low, low and moderate
income households. Developers of projects with 11 or more dwelling units are
required to participate in discussions with City staff to evaluate the feasibility
of providing affordable units. Such discussions are encouraged to occur early
in the development review process, notably prior to the filing of
applications.Various incentives are available to assist in making it economically feasible
for developers to provide affordable housing. Incentives such as increases
to residential density and reductions to development standards are available
by request and approval of a conditional use permit. Financial assistance
through local, state and federal programs may also be requested. The New
Housing Construction Policy, the available incentives and the development
process involved with detennining feasibility are described in the City's
Affordable Housing Plan, which supplements the Orange General Plan
Housing Element."
SECTION II:
A summary of this Ordinance shall be published and a certified copy of the full
text of this Ordinance shall be posted in the Office of the City Clerk at least five days
prior to the City Council meeting at which this Ordinance is to be adopted. A summary
of this Ordinance shall also be published once within fifteen (15) days after this
Ordinance's passage in a newspaper of general circulation, published, and circulated in
the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified
copy of the full text of such adopted Ordinance along with the names of those City
Council members voting for and against the Ordinance in accordance with Government
Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the
date of its final passage.
