94 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING SECTION 17.90.
030 OF THE ORANGE MUNICIPAL CODE
RELATING TO LENGTH OF TIME A LEGAL
NON-CONFORMING RESIDENTIAL STRUCTURE
MAYBE REPLACED The City Council of the City of Orange does ordain
as follows:
SECTION I:Section 17.90.030 is hereby amended to read
as follows:17.90.030 Destruction of Building--
Conformance Reouired When.1. If at any time any non residential building which does not
conform to the regulations for the district in which it is located is destroyed by fire,
explosion, act of God or act of the public enemy, to the extent of more than seventy five
percent of the assessed value thereof, according to the assessment thereof by the
County Assessor for the fiscal year during which such destruction occurs, then and without
further action by the City Council, the building and the land on which the building
was located or maintained shall from and after the date of such destruction be subject
to all the regulations specified by this title for the district in which such land
and
building are located.2. Any non conforming residential structure or structures which
are damaged or partially destroyed by fire, explosion, act of God, act of a public enemy,
collapse, or any other casualty or calamity, may be reconstructed to the conditions which
existed prior to the casualty or calamity, provided the structure or structures existed
as legally established structures. All such construction or repairs shall be started within two years
from date of danlage and shall be pursued diligently to completion. Otherwise,
the legal non conforming status of the structure(s)
shall be
lost.SECTION II:A sununary of this Ordinance shall be published and a certified copy
of the full text of this Ordinance shall be posted in the Office of the City Clerk at least
five (5) days prior to the City Council meeting at which this Ordinance is adopted. A
sununary of this Ordinance shall also be published once within fifteen (15) days after
this Ordinance's passage in a newspaper of general circulation, published, and circulated in
the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified
full text of such adopted Ordinance along with the names of those City Council members
voting for and against the Ordinance in accordance with Government Code Section
36933. This Ordinance shall take effect thirty (30) days from and after the date of its
fmal passage.
