94 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING CHAPTER 15.36
OF THE ORANGE MUNICIPAL CODE RELATING
TO FIRE RETARDANT ROOF COVERING
REQUIREMENTS.WHEREAB, the use of non-fire retardant roofingisacontributingfactortothespreadoffires and resultinglossoflifeand
property; and WHEREAS, public health and safety would beprotectedbyeliminatingtheuseofnon-fire
retardant roofing materials.NOW, THEREFORE, the City Council of the CityofOrangedoes
ordain as
follows:SECTION I:Section 15.36.020 of Chapter 15.36 of Title 15oftheOrangeMunicipalCodeisamendedbydeletingtherefromSubsection (f)entitled "Alterations" of Section 1603 oftheUniformBuildingCodewhichwaspreviouslyincorporatedbyreferenceintosaidSection
15.36.
020.SECTION II:Chapter 15.36 of Title 15 is furtheramendedbydeletingSection15.36.030.in its entirety andaddingnewSection15.36.030 to
read as follows:Section 15.36.030 Roof CoverinaRequirementswithinthe
City of Oranqe.a) Fire Retardancy. NotWithstanding anyotherrequirementoftheCityofOrangeMunicipalCode, andexceptasotherwiseprovidedinthisSection, roof coverings shallbefireretardantU.L.
listed Class A.
1. General Prohibition.All roof coverings installed on any neworexistingbuildingorstructure, shall be fire retardant U.L.
listed Class A.2. Re-roofing over Wood Shakes andWood
Shingles shall be Prohibited.No roof covering shall be appliedoverexistingwoodshakesorwoodShingles. When a roof has two ormorebuilt-up layers of roof covering, any layer of which iswoodshakeorwoodshingle,all built-up roofcoveringshallbecompletelyremoved
before applying a new roof covering.
The requirements of subsection (a) 1. shall not apply when a
building or structure is subject to roof installation, addition,
repair, alteration or replacement of less than 25% of the
existing building or structure's roof covering area over the li~e
of the building commencing on or after the effective date of th~s
ordinance. In such circumstances, roof coverings with a Class
B" rating, including pressure-treated wood shakes orpress';
lre-treated wood shingles, may be used. For the purposes of th~
s ordinance, 25% of the roof covering area shall be calculated
from the area of roof covering existing on the effective date of
this
ordinance.b) Other roof covering
requirements.1. The roof covering on any structure regulated by
this code shall be as specified in Table No. 32-A and as
classified in section 3204 of the Uniform Building code, as adopted
and amended by
the city.2. The roof-covering assembly shall also be
U.L. Listed Class "A" rated and includes
the roofdeck, underlayment,interlayment, insulation and covering which is
assigned a
roof-covering
classification.SECTION III:A summary of this Ordinance shall be
published and a certified copy of the full text of this Ordinance
shall be posted in the Office of the city Clerk at least five (5)
days prior to the City Council meeting at which this Ordinance
is to be adopted. A summary of this Ordinance shall
also be published once within fifteen (15) days after this Ordinance's
passage in a newspaper of general circulation, published,
and circulated in the City of Orange. The City Clerk shall post in
the Office of the City Clerk a certified copy of the full text
of such adopted Ordinance along with the names of those
City council members voting for and against the Ordinance
in accordance with Government Code section 36933. This Ordinance
shall take effect thirty (30) days from and after the date of
its final passage.Adopted this 22nd day
