HomeMy WebLinkAboutORD-01-94 Amend Sec. 10.34.060 F Prohibited Parking of Trucks and Similar VehiclesORDINANCE NO. 1- 94 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 10.34.060 F. OF THE ORANGE MUNICIPAL CODE REGARDING PROHmITED PARKING OF TRUCKS AND SIMILAR VEHICLES WHEREAS, the City Council desires to limit the size of trucks and similar vehicles in certain areas within the City, including residential areas; and WHEREAS, Section10.34,060 F. of the Orange Municipal Code lists three characteristics of a motor truck, truck tractor with or without attached trailer, or any trailer. The existence of two of the characteristics limits the ability of such a vehicle to be parked in certain locations within the City, including residentially developed areas (as defined in Section 10.34. 060 F.); and WHEREAS, said characteristics are used to ascertain the threshold beyond which such vehicles are considered too large to be parked in certain areas. These characteristics focus on number and size of wheels and number of axles; and WHEREAS, said characteristics do not adequately address the overall length of said vehicles, which has the potential to create aesthetic and compatibility problems in residentially developed areas ifleft unregulated,NOW, THEREFORE the City Council ofthe City of Orange does ordain as follows:SECTION I:Section10.34.060 F, of the Orange Municipal Code is hereby amended to read as follows:10.34,060 Prohibited Parking--Trucks and Similar Vehicles. No person shall park and leave standing on any public street; any public or dedicated alley; any public property; or, in any Residentially Developed Area as defined in this section, any private property; any of the following vehicles, except while mechanically disabled, or while loading or unloading merchandise, goods,or building materials; or when such vehicle is parked in connection with, and in the performance of a service to or on a property in the block in which such vehicle is parked or left standing:A. Any trailer not attached to a motor vehicle, except recreational vehicles, as defined in the Health and Safety Code;B. Any bus, as defined by the California Vehicle Code;C. Farm machines;D. Special purpose machines;E. Any unlicensed vehicles; and F, Any motor truck, any truck tractor with or without attached trailer, and any trailer as defined by the California Vehicle Code, with any two of the following 1. A diameter of the wheel rim of seventeen inches or larger; 2, Having more than two axles; 3. Having more than two wheels on any axle; or 4. Having a storage bed or platform of greater than sixteen (16) feet in length, This feature shall be applied only in Residentially Developed Areas as defined in this section and shall not be applied to recreational vehicles as defined in the Health and Safety Code, As used in this section, "residentially developed area" shall mean that portion ofa highway and the property contiguous thereto, other than a business district: 1. Upon one side of which highway, within a distance of a quarter ofa mile, the contiguous property is occupied by thirteen or more dwelling units; or 2. Upon both sides of which highway, within a distance of a quarter of a mile, the contiguous property is occupied by sixteen or more dwelling units, whether or not the dwelling units front on said highway and whether or not the dwelling units are single-family or multiple-family in character.In areas other than residentially developed areas, this parking prohibition does not apply when:1. The vehicle is parked for less than thirty minutes to accommodate the seeking of directions, the opening of gates or facilities, or for refreshments; or 2, When the self-propelled vehicle is occupied by a duly licensed operator awaiting the opening of a closed facility for purposes of loading or unloading.Any commercial vehicle parked upon any street or alley in the commercial or industrial areas for any purposes during the hours of darkness shall be required to place and maintain a minimum of three (3) reflective triangular parked vehicle delineators evenly spaced over a distance of one hundred feet (100') behind the parked vehicle or equipment.SECTIONll:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted, A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange, The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in Government Code Section 36933, This Ordinance shall take effect thirty (30) days from and after the date of its final passage, Adopted this 18th day of January 1994.
