A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE ADOPTING THE EXEMPTION
FROM THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT (CEQA) FOR WELLS 20, 21 & 22
PFOA AND PFOS TREATMENT PLANTS
CONSTRUCTION AND OPERATION
WHEREAS, the City of Orange (the "City") is a municipal corporation which exercises
governmental functions and powers and is organized and existing under the laws of the State of
California; and
WHEREAS,the City of Orange staff determined that a treatment plant for PFOA and PFOS
compounds is required to reduce concentrations in drinking water extracted from the groundwater
basin at existing and future well connections; and
WHEREAS,the City of Orange, in its capacity under the California Environmental Quality
Act(CEQA),has conducted an evaluation of the potential for environmental impacts associated with
the City of Orange Wells 20, 21 & 22 Project; and
WHEREAS, such evaluation determined that the Project is consistent with the applicable
Categorical Exemption(Class 3, Section 15303) under CEQA as it consists of the construction and
operation of small treatment plants and associated connection facilities at previously disturbed sites
representing the development of limited numbers of new, small facilities or structures and it would
not result in any significant impacts to the environment.
NOW,THEREFORE,the City Council of the City of Orange resolves, finds and determines,
on the basis of the facts set forth in the agenda report presented to it, as follows:
Adopts the finding that the City of Orange Wells 20,21 &22 Project is exempt from CEQA pursuant
to Section 15303 of the CEQA Guidelines because it consists of the construction and operation of
small treatment plants and associated connection facilities at previously disturbed sites representing
the development of limited numbers of new, small facilities or structures and it would not result in
any significant impacts to the environment.The foregoing recitals are true and correct.
