COMMISSION ON DECEMBER 5, 2022 MINUTES City of Orange Planning Commission November 07, 2022 The Planning Commission of the City of Orange, California convened on Monday, November 7, 2022, at 7:00 p.m. in a Regular Meeting in the Council Chamber, 300 E. Chapman Avenue, Orange, California. 1. OPENING/CALL TO ORDER Chair Vazquez called the meeting to order at 7:00 p.m. 1.1 PLEDGE OF ALLEGIANCE Commissioner Simpson led the flag salute. 1.2 ROLL CALL Present: Glasgow, Simpson, Martinez, Trapesonian, and Vazquez Absent: None 2. PUBLIC COMMENTS None 3. CONSENT CALENDAR All matters listed under the Consent Calendar are considered to be routine by the Planning Commission and will be enacted by one motion. There will be no separate discussion of said items unless members of the Planning Commission, staff or the public request specific items removed from the Consent Calendar for separate action. 3.1. Approval of meeting minutes of the Planning Commission of the City of Orange 3 for the October 17, 2022, Regular Meeting. Item 3.1 was removed from the Consent Calendar for separate consideration by Chair Vazquez. Chair Vazquez provided staff with minor edits to the October 17, 2022 minutes. ACTION: A motion was made by Chair Vazquez, seconded by Vice Chair Glasgow, to approve the minutes as amended. The motion carried by the following vote: Ayes: Glasgow, Martinez, Trapesonian, and Vazquez Noes: None Absent: None Abstain: Simpson Page 1 of 4 SCANNED Planning Commission Minutes November 7,2022 3.2. One-year extension for Conditional Use Permit No. 3085-19, Major Site Plan Review No. 0972-19, Design Review No. 4973-19, and Mitigated Negative Declaration No. 1866-19 for the construction of a new two-story, 30,113 square-foot memory care facility at 574 S. Glassell Street. ACTION: Approve a one-year time extension for Conditional Use Permit No. 3085-19, Major Site Plan Review No. 0972-19, Design Review No. 4973-19, and Mitigated Negative Declaration No. 1866-19 based on Orange Municipal Code Section 17.08.060. Approval of the Consent Calendar Item 3.1 was removed from the Consent Calendar and heard separately. Commissioner Simpson abstained from Items 3.1 and 3.2 due to his absence from the previous meeting. A motion was made by Commissioner Martinez, seconded by Vice Chair Glasgow, to approve the Consent Calendar as recommended. The motion carried by the following vote: Ayes: Glasgow, Martinez, Trapesonian, and Vazquez Noes: None Absent: None Abstain: Simpson 4. ASSISTANT COMMUNITY DEVELOPMENT DIRECTOR REPORTS None. 5. NEW HEARINGS 5.1. Continued Public Hearing to consider Conditional Use Permit No. .3156-22, Sauced BBQ and Spirits Axe Throwing, 1535 West Katella Avenue, and finding of CEQA exemption. (Continued from 10/3/2022) Chair Vazquez opened the public hearing. Public Speaker: Barrett Gomes, applicant, answered the Commissioners' questions about the project. Chair Vazquez closed the public hearing. The Commissioners discussed the following: • Current authorization for axe throwing • Monitoring alcohol consumption of axe throwing patrons • Staffing of axe throwing stations A motion . was made by Vice Chair Glasgow, seconded by Commissioner Trapesonian, to adopt Planning Commission Resolution No. 25-22 entitled: A Resolution of the Planning Commission of the City of Orange approving Conditional Use Permit No. 3156-22 for an accessory 596 square foot commercial recreational facility use, axe throwing, in association with the operation of a 7,681 square foot full-service restaurant located at 1535 West Katella Avenue. Page 2 of 4 Planning Commission Minutes November 7,2022 The motion carried by the following vote: Ayes: Glasgow, Simpson, Martinez, Trapesonian, and Vazquez Noes: None Absent: None (Item 5.3 was reordered to be heard before Item 5.2.) 5.3. Public Hearing to consider Conditional Use Permit No. 3188-22, Zinc Cafe and Market, 195 S. Glassell Street, and finding of CEQA exemption. Chair Vazquez opened the Public Hearing. Public Speakers: Todd Cottle, applicant, spoke in support of the project. Detective Mike Murphy, Orange Police Department, answered the Commissioners' questions. Chair Vazquez closed the Public Hearing. The Commissioners discussed the following: • Outdoor dining on the Almond Avenue side of building • The amount and type of seating on the patio • Exit gates for the outdoor dining area and potential for patrons to leave with alcohol • Proximity of sensitive uses on Almond Avenue A motion was made by. Chair Vazquez, seconded by Commissioner Simpson, to adopt amended Planning Commission Resolution No. 30-22 with additional conditions entitled: A Resolution of the Planning Commission of the City of Orange approving Conditional Use Permit No. 3188-22 for a State of California Department of Alcoholic Beverage Control Type 47 License (On-Sale General - Eating Place) for a new restaurant, located at 195 S. Glassell Street. Added Conditions: 1)There is to be an alarm located on each side of the gate 2) Patio seating has a maximum occupancy of 46 patrons 3)Title change for Resolution 3188-21 to Resolution 3188-22 The motion carried by the following vote: Ayes: Glasgow, Simpson, Martinez, Trapesonian, and Vazquez Noes: None Absent: None Page 3 of 4 _: Planning Commission Minutes November 7,2022 5.2. Public Hearing to consider revising the Zoning Code to establish a Neighborhood Preservation Overlay District and finding of CEQA exemption. Chair Vazquez opened the Public Hearing; there being no speakers, Chair Vazquez closed the Public Hearing. The Commissioners discussed the following: • Exterior doors from bedrooms • Required open space and storage • Floor area limitations • Definitions of"Dormitory" and "Student Housing" A motion made by Vice Chair Glasgow, seconded by Commissioner Simpson to adopt amended Planning Commission Resolution No. 29-22 with modified definitions of "Dormitory" and "Student Housing" to clarify that each is "occupied by students of providers of higher education." PC Resolution No. 29-22. A recommendation to the City Council to revise the Zoning Code to establish a Neighborhood Preservation Overlay District and establish development standards applicable to specified projects adding bedrooms and bathrooms to a primary residence. The motion carried by the following vote: Ayes: Glasgow, Simpson, Martinez, Trapesonian, and Vazquez Noes: None Absent: None 6.
