The City Council adopts by reference the Uniform Building Code, 1994 Edition, copyright 1994 by the International Conference of Building Officials as adopted and amended in the California Building Code, and said Uniform Building Code is adopted in total as the law of the City except as provided for in this chapter. One copy of the Code has been and is now fIled with the office of the City Clerk, and said Code is adopted by reference as if incorporated and set out at length in this chapter.Section 15.04.020 Fee Schedule. The Uniform Building Code, 1994 Edition is amended by deleting Table No. I-A Building Permit Fees, Table A33-A Grading Plan Review Fees, Table A33-B Grading Permit Fees, and by providing that fees shall be established by resolution of the City Council.Section 15.04.030 Work Exempt from Permits. Section 106. 2 of the Uniform Building Code, 1994 Edition is amended by adding item #12 "Free standing concrete or masonry walls not exceeding 42" in height above finish grade".Section 15.04.040 Chll,pter 9 Fire- Protection Systems. Amended. For the purpose of this chapter, the Fire Marshal shall be responsible for plan review,and inspection of fire protection systems such as fire sprinklers, fixed systems installed in grease hoods and halon systems and detection systems which sense smoke, fire, heat or products of combustion.Section 15.04.050 Chapter17 Structural Tests and In!lPCCtions. Amended.Section 1701.5 of the Uniform Building Code, 1994 Edition is amended by adding item #16 "Plumbing Installations" based on Appendix Chapter F of the 1994 Edition of the Uniform Plumbing Code.Section 15.04.060 Chapter 33 Site Work. Demolition and Construction.Amended. For the purpose of this chapter only, the "Building Official" shall be the City Engineer or Section 15.04.070 Imposition of Stricter Standards. Whenever Chapter 15.32, Uniform Fire Code Section 15.32.010 et ~., imposes stricter standards than imposed by this code, Chapter 15.32, Uniform Fire Code, is to govern. Section 15.04.080 Uniform Buildin~ Code roBC) Appendix. The City Council adopts by reference the Uniform Building Code Appendix, 1994 Edition, copyright 1994 by the International Conference of Building Officials as adopted and amended in the California Building Code, and said Uniform Building Code Appendix is adopted in total as the law of the City except as provided for in this chapter. Excluded from this adoption are Appendix Chapter 3, Division I; Appendix Chapter 4; Appendix Chapter 10; Appendix Chapter 13; Appendix Chapter 29; Appendix Chapter 30; Appendix Chapter 31, Division I; and Appendix Chapter 33. One copy of the Code has been and is now filed with the office of the City Clerk, and said Code is adopted by reference as if incorporated and set out at length in this chapter. Section 15.04.090 Violations and Penalties. A. It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, convert or demolish, equip, use, occupy or maintain any building or structure in the City, or cause the same to be done or to perform or maintain any grading work or cause the same to be done, contrary to, or in violation of, any of the provisions of this chapter. B. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment. C. In addition, this code may be enforced by injunction or bv other appropriate civil remedy. Section IT: The Orange Municipal Code is hereby amended by revising Chapter 15.08 in its entire~y to read as follows: CHAPTER 15.08 UNIFORM HOUSING CODE BD 3-ORD. 17- Sections: 15.08.010 Adopted by Reference 15.08.020 Violations and Penalties Section 15.08.010 Ado,pted by Reference. The City Council adopts by reference the Uniform Housing Code, 1994 Edition, Copyright 1994 by the International Conference of Building Officials, and said Uniform Housing Code is adopted in total as the law of the City except as provided by this Chapter. One copy of the code has been and now is filed in the office of the City Clerk, and the code is adopted by reference as if incorporated and set out in length in this chapter. Section 15.08.020 Violations and Penalties. A. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment. B. In addition, this code may be enfor,ced by injunction or by other appropriate civil remedy. One copy of the code has been and now is filed in the office of the City Clerk and the code is adopted by reference as if incorporated and set out at length in this chapter. ORD.17-95 4- Section 15.12.020 Fee Schedule. The Uniform Mechanical Code, 1994 Edition is amended by deleting sections 115.2 and 115.3 and by providing that fees for the issuance of mechanical permits, for checking of mechanical plans and for fees for the investigation of work done without permits shall be as established by resolution of the City Council. Section 15.12.030 Violations and Penalties. A. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment. B. In addition, this code may be enforced by injunction or by other appropriate civil remedy. BD 5-ORD.17- Section 15.16.020 Fee Schedule. The Unifonn Plumbing Code, 1994 Edition, is amended by deleting the schedule of fees contained in Section 103.4 and Table 1-1 and by providing that fees shall be established by resolution of the City Council.Section 15.16.030 Unifonn Plumbinl1 Code Awendix. The City Council adopts by reference the Uniform Plumbing Code Appendix, 1994 Edition,copyright 1994 by the International Association of Plumbing and Mechanical Officials as adopted and amended in the California Building Code, and said Unifonn Plumbing Code Appendix is adopted in total as the law of the City except as provided for in this chapter. Excluded from this adoption is Appendix E. One copy of the Code has been and now is filed in the office of the City Clerk and the code is adopted by reference as if incorporated and set out at length in this Chapter.Section 15.16.040 AP.Pendix F Medical Gas Systems. SectionF3(b) is revised to read as follows: "Certification of medical gas and medical vacume systems shall confonn to the requirements of this Code and the department having jurisdiction, and all installations shall be inspected by a special inspector per UBC Chapter 17 requirements".Section 15.16.050 Violations and Penalties.A. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment.B. In addition, this code may be enforced by injunction or by other appropriate civil remedy.Section V:The Orange Municipal Code is hereby amended by revising Chapter 15.20 in its entirety to read as follows:CHAPTER 15. 20 UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS Sections:15.20.010 Adopted by Reference 15.20.020 Violations and Penalties ORD.17-95 Section 15.20.010 Adopted by Reference. The City adopts by reference the Uniform Code for Abatement of Dangerous Buildings, 1994 Edition, copyright 1994 by the International Conference of Building Officials, and said code is adopted in total as the law of the City except as provided in this Chapter. One copy of the code has been and now is filed in the Office of the City Clerk, and said Code is adopted by reference as if incorporated and set out at length in this chapter. Section 15.20.020 Violations and Penalties. A. Any person, firm or corporation violating any of the provisions of this Chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violations of any of the provisions of this Chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment. B. In addition, this Code may be enforced by injunction or by other appropriate civil remedy. Section VI: The Orange Municipal Code is hereby amended by revising Chapter 15.24 in its entirety to read as follows: CHAPTER 15.24 NATIONAL ELECTRICAL CODE Sections: 15.24.010 Adopted by Reference 15.24.020 Fee Schedule 15.24.030 Violations and Penalties Section 15.24.010 Adooted by Reference. The City adopts by reference the National Electrical Code, 1993 Edition, entitled "National Electrical Code" published by the National Fire Protection Association (N.F.P.A.), and including the "Uniform Administrative Provisions for the National Electrical Code", 1993 Edition published by the International Conference of Building Officials, pages 1-12, and 70-1 to 70-917 inclusive as adopted and amended in the California Building Code, and said code is adopted in total as the law of the City except as provided for in this Chapter. One copy of the Code has been and now is filed in the office of the Cily Clerk, and said Code is adopted by reference as if incorporated and set out at length in this Chapter.BD Section 15.24.020 Fee Schedule. The National Electrical Code, 1993 Edition, is amended by deleting the schedule of fees contained in Table 3-A and by providing that fees shall be established by resolution of the City Council.Section 15.24.030 Violations and Penalties.A. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment.B. One copy of the Code has been and now is filed in the office of the City Clerk, and said Code is adopted by reference as if incorporated and set out at length in this Chapter.Section 15.25.020 Fee Schedule. The "Uniform Sign Code", 1994 Edition, is amended by deleting the schedule of fees contained in Table 3-A and by providing that fees shall be established by resolution of the City Council.ORD.17- Section 15.25.030 Violations and Penalties. A. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment. Section 15.48.020 Fee Schedule. Section X: The Orange Municipal Code is hereby amended by revising Chapter 15.56 in its entirety to read as follows: CHAPTER 15.56 STATE HISTORICAL BUILDING CODE Sections: 15.56.010 Adopted by Reference 15.56.020 Violations and Penalties Section 15.56.010 Adopted by Reference. The City adopts by reference the State Historical Building Code", 1994 Edition, published by the California Office of Administrative Hearings Department of General Services, as adopted and amended in the California Building Code, and said code is adopted in total as the law of the City except as provided for in this Chapter. One copy of the Code has been and now is filed in the office of the City Clerk, and said Code is adopted by reference as if incorporated and set out at length in this Chapter. Section 15.56.020 Violations and Penalties. A. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment. B. In addition, this code may be enforced by injunction or by other appropriate civil remedy. Section XI: The Orange Municipal Code is hereby amended by the addition of a new Chapter 15.64 to read as follows: BD 11-ORD.17- CHAPTER 15.64 UNIFORM CODE FOR BUILDING CONSERvAnON Sections: 15.64.010 Adopted by Reference 15.64.020 Violations and Penalties Section 15.64.010 Ado..pted by Reference. The City adopts by reference the Appendix Chapter I of The Uniform Code for Building Conservation", 1994 Edition, published by the International Conference of Building Officials, as adopted and amended in the California Building Code, and said code is adopted in total as the law of the City except as provided for in this Chapter. One copy of the Code has been and now is filed in the office of the City Clerk, and said Code is adopted by reference as if incorporated and set out at length in this Chapter. Section 15.64.020 Violations and Penalties. A. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment. B. In addition, this code may be enforced by injunction or by other appropriate civil remedy. Section XII: The Orange Municipal Code is hereby amended by the addition of a new Chapter 15.68 to read as follows: CHAPTER 15.68 UNIFORM ADMINISTRATIVE CODE Sections: 15.68.010 Adopted by Reference 15.68.020 Violations and Penalties ORD.17-95 12- Section 15.68.010 Adopted by Reference. The City adopts by reference the Uniform Administrative Code", 1994 Edition, published by the International Conference of Building Officials, as adopted and amended in the California Building Code, and said code is adopted in total as the law of the City except as provided for in this Chapter. One copy of the Code has been and now is filed in the office of the City Clerk, and said Code is adopted by reference as if incorporated and set out at length in this Chapter. Section 15.68.020 Violations and Penalties. A. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of the provisions of this chapter is committed, continued, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fme and imprisonment. B. In addition, this code may be enforced by injunction or by other appropriate civil remedy. Section XIlI: If any section, subsection, sentence, clause, phrase, part or portion of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competentjurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council declares it would have adopted this Ordinance and each section" subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases, parts or portions be declarc:d invalid or unconstitutional. Section XIV: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in the Orange City News, a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the OffIce of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for an against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect on January I, 1996.
