95 AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ORANGE AMENDING
CHAPTER 10.06 OF THE ORANGE MUNICIPAL
CODE REGARDING THE CITY TRAFFIC
COMMISSION WHEREAS, Chapter 10.06 of the Orange Municipal Code establishes a City
Traffic Commission and sets out its duties;
and WHEREAS, the duties of the City Traffic Commission have been considered
advisory to the City Council;
and WHEREAS, it is the desire of the City Council to authorize the City Traffic
Commission to take final action on certain matters that come before the
Commission.NOW, THEREFORE, THE CITY COUNCil OF THE CITY OF ORANGE
HEREBY ORDAINS AS
FOllOWS:SECTION
I:Section 10.06.010 is hereby amended to read as
follows:10.06.010 Created - MembershiD. A City Traffic Commission is created consisting of
five res,idents of the City, one resident being a School District representative, appointed by the
Mayor with the consent of the Council. The Chief of Police, or his designee, and the City
Traffic Engineer, or his designee, shall serve as City staff representatives to the City Traffic
Commission. The City Traffic Engineer shall serve as Secretary to the Commission.
SECTION II:
Section 10.06.040 is hereby amended to read as follows:
10.06.040 Meetinas and Quorum. Three members shall constitute a quorum. A
majority vote of the quorum present, shall be required for all Commission actions. Failure to
achieVEl a majority vote of members present shall constitute a denial of the proposed action.
The re!~ular meetings of the Traffic Commission shall be held in the City Council Chambers,
Civic Center, 300 East Chapman Avenue, Orange, California, or at such other place as may be
designated by the Traffic Commission, on the second Wednesday of each month and shall
convene at the hour of 3:30 p.m. If any regular meeting date should fall on a holiday, the
same day in the following week shall be designated as the meeting day.
SECTION III.
Section 10.06.080 is hereby amended to read as follows:
10.06.080 Duties of Traffic Commission:

The City Traffic Commission is hereby
A. To review and ad as specified in the context of the Chapter in matters of traffic and
transportation engineering.
B. To cause the notification of those individuals, organizations or agencies who would
have an interest in an agendized item to be considered by the Traffic Commission.
C. To convene advertised Public Hearings as hereinafter described for the purpose of
soliciting public comments on items to be considered and aded upon thereafter by
the Traffic Commission.
D. To review and ad on all traffic and transportation engineering studies,
investigations and reports as presented by the Secretary of the Traffic Commission
pertaining to the installation, modification or removal of traffic control devices and
the operation or modification of the multi-model transportation
system.E. To initiate traffic and transportation engineering studies as needed or in response
to requests from individuals, groups or
agencies.F. To assist the City Planning Commission, City Council, City staff or other
city affiliated individuals, groups or organizations with traffic and
transportation engineering
issues.G. To perform such other functions as the City Council may, from time to time,
require.Adion taken by the City Traffic Commission shall be considered final unless
appealed to the City Council in accordance with the procedures established below. Additionally,
the following adion shall be advisory to the City Council and as such for these items,
the Commission shall make a report together with recommendations for adions to the City
Council:A. Action involving a matter for which State law requires a decision by the City
Council.B. Action involving traffic improvements which have not been previously
budgeted.C. Adion involving traffic related modifications to a larger geographic area,
as opposed to a single location-
specific item.
SECTION IV.Section 10.06.081 is hereby added to Chapter 10.06 to read
as follows:10.06.081 Duties of Secretary to Traffic Commission: The Secretary to \
he Traffic Commission is
hereby authorized:A. To ad in his capacity as City Traffic Engineer in causing the
investigation, analysis,documentation and study and report preparation to determine the need
to install,modify or remove traffic
control devices.B. To agendize traffic and transportation engineering reports and post
the Traffic Commission Agenda, and other legal notices, within the time limits and
at the places prescribed by State and
C. To notify, prior to a scheduled Traffic Commission meeting, those individuals,
organizations or agencie~ who may have an interest in an agendized Traffic
Commission item of the time date and location where as that item will be considered
by the Traffic Commission.
D. To submit Traffic Commission Agendas to the City Council and City Clerk prior to
the scheduled Traffic Commission meetings within the time periods prescribed by
State law.
E. To present studies and reports, or other pertinent data, for the installation,
modification, or removal of traffic control devices to the Traffic Commission.
F. To cause and maintain, upon approval of the Commission, full and correct minutes
of each Traffic Commission meeting.
G. To submit a summary of the Traffic Commission's actions to the City Council and
City Clerk following each Traffic Commission meeting.
H. To forward to the City Council those items acted on by the Traffic Commission
meeting the criteria of required City Council action as described in Section
10.06.080 Duties of this Chapter.
I. To prepare required Traffic Commission Resolutions denoting the findings of the
Traffic Commission. The resolution shall be signed by the Chairman of the Traffic
Commission and attested to by the Secretary to the Traffic Commission. The
original resolution shall be forwarded to the City Clerk and a copy shall be retained
by the Secretary to the Traffic Commission.
J. To prepare and submit to the City Council, once each year, a resume of the Traffic
Commission actions of the preceding year.
K. To act in his capacity as City Traffic Engineer in implementing the actions of the
Traffic Commission and City Council.
SECTION V:
Section 10.06.085 is hereby added to Chapter 10.06 to read as follows:
Section 10.06.085 ADDeals to City Council. All acts and determinations of the Traffic
Commic;sion are directly reviewable by the City Council which may affirm, reverse or modify
al"'Y such act or determination as it deems in the best interests of the City.
A. An appeal from a decision or requirement of the Traffic Commission may be made
by any interested party.
B. Any appeal from the decision of the Traffic Commission shall be made within fifteen
calendar jays following the date of the decision of the Commission.
C. Appeals shall be in writing.
D. The written application for appeal shall state the ground for the appeal.
E. The original of the appeal shall be filed in duplicate with the City Cler\(.
F. If an appeal is requested, the same shall be heard in the same manner as
prescribed for a public hearing before the Traffic Commission, upon notice.
SECTION VI:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Cler\( at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after this Ordinance's passage in a
newspaper of general circulation, published, and circulated in the City of Orange. The City
Cler\( shall post in the Office of the City Cler\( a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting for and against the
Ordinance in accordance with Govemment Code Section 36933. This Ordinance shall take
effect thirty (30) days from and after the date of its final passage.
