96 AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ORANGE AMENDING TITLE
15 OFTHEORANGEMUNlC~
ALCODERELATING TO EXEMPTION FROM THE
REQUIREMENT OF BUILDING AND RELATED
PERMITS WHEREAS, the City of Orange has adopted by reference in Title 15 of the
Orange Municipal Code, the Uniform Building Code, 1994 Edition, the Uniform Mechanical Code,
1994 Edition, the Uniform Plumbing Code, 1994 Edition, and the National Electrical Code,
1993 Edition;
and WHEREAS, the above mentioned codes generally contain requirements that
building projects may only be pursued after a permit is obtained from the building official;
and WHEREAS, the abovementioned codes each contain a list of types of projects which
are exempt from the requirement to obtain the permit;
and WHEREAS, the City Council desires to expand the list of types of projects which
are exempt from the permit
requirement.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE
HEREBY ORDAINS AS
FOLLOWS:SECTION
I:Section 15.04.030 if the Orange Municipal Code is amended to read as
follows:Section 15.04.030 Work Exempted from Permits. Section 106.2 of the Uniform
Building Code, 1994 Edition is amended by adding the
following:finish
grade.12. Free standing concrete or masonry walls not exceeding 42" in height
above 13. TV dishes and flag poles in connection with a Group R, Division 3
occupancy and not exceeding 15 feet in
height.14. Playground equipment and similar type recreational
structures.106.
2:In addition, the following amendments shall be made to existing subsections of
1. One story detached accessory building used as tool and storage sheds,
playhouses, private lath houses, glass houses, gazebos and similar structures and uses, provided
projected roof area does not exceed 150 square feet.
2. Wood and chain link fences not over 6 feet.
11. Prefabricated swimming pools accessory to a Group R, Division 3 occupancy
in which the pool walls are entirely above the adjacent grade and if the capacity does not exceed
5,000 gallons. Ifpool contains water over 24 inches deep, a pool barrier shall be required.
SECTION II:
Section 15.12.025 shall be added to the Orange Municipal Code to read as follows:
15.12025 Work Exempt from Permits. Section 112.2 of the Uniform Mechanical Code,
1994 Edition is amended by adding the following item:
6. Replacement of any appliance of the same type and size and in the same location and in
connection with a Group R, Division 3 occupancy."
SECTION III:
Section 15.16.025 shall be added to the Orange Municipal Code to read as follows:
Section 15.16.102 Work Exempt from Permits. Section 103.1.2 of the Uniform Plumbing
Code, 1994 Edition is amended by adding the following:
103.1.2.3 Repair or replacement of any plumbing fixture or appliance of the same type
and size and in the same location.
SECTION IV:
Section 15.24.025 shall be added to the Orange Municipal Code to read as follows:
Section 15.24.025 Work Exempt from Permits. Section 301 (b) of the National Electrical
Code, 1993 Edition is amended by adding the following items:
15. Installation of a ceiling fan within an existing outlet.
16. Repair or replacement of an outlet or receptacle of the same type and in the
same location.

A summary of this Ordinance shall be published and a certified copy of the
full text of this Ordinance shall be posted in the Office of the City Clerk at least five
5) days prior to the City Council meeting at which this Ordinance is to be adopted.
A summary of this Ordinance shall also be published once within fifteen (15) days
after this Ordinance's passage in a newspaper of general circulation, published, and
circulated in the City of Orange. The City Clerk shall post in the Office of the City
Clerk a certified copy of the full text of such adopted Ordinance along with the
names of those City Council members voting for and against the Ordinance in
accordance with Government Code Section 36933. This Ordinance shall take effect
thirty (30) days from and after the date of its final passage.
