HomeMy WebLinkAboutORD-27-96 Establish Term Limits for City Council and MayorORDINANCE NO. 27- 96 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ESTABLISHING TERM LIMITS FOR THE OFFICES OF CITY COUNCIL AND MAYOR WHEREAS, on November 5, 1996, a majOlity of those voting in an election held on that date in the City of Orange passed a measure which provides that the City of Orange Council Members shall be limited to a maximum of two consecutive four-year terms and the elected Mayor shall be limited to a maximum ofthree consecutive two- year terms; and WHEREAS, in adopting this Ordinance the City Council of the City of Orange IS carrying out the intent of a majority of those voting in said election.NOW, THEREFORE, the people of the City of Orange do ordain as follows:SECTION I:Chapter 2.05 is added to the Orange Municipal Code to read as follows:TERM LIMITS -, CITY COUNCIL AND MAYOR Section 2. 05.010 Section 2. 05.020 Section 2. 05.030 Section 2. 05.040 Section 2. 05.050 Term Limits of City Council Members Term Limits of Mayor Term Limits for Consecutive Offices Consecutive Ternl Defined Prospective Application Section 2.05.010 Term Limits of City Council Members. No person shall serve more than two consecutive four-year terms as a membe:r of the City Council. No person who has served more than six consecutive years as a member of the City Council, whether appointed or elected, may serve an additional consecutive term as a member of the City Council.Section 2.05.020 Term Limits of Mayor. No person shall serve more than three consecutive two-year terms as Mayor. No person who has served more than five consecutive years as Mayor, whether appointed or elected, may serve an additional consecutive term as Mayor.Section 2.05.030 Term Limits for Consecutive Offices. Notwithstanding any other provision of this Chapter, no person shall serve more than 14 consecutive years in the offices of City Council and Mayor. No person who has served more than 12 consecutive years in the offices of Mayor and City Council, whether appointed or elected, may seek an additional consecutive Section 2.05.040 Consecutive Term Defined. For purposes of determining consecutive term limits and years pursuant to this Chapter, terms or years as Mayor or member of the City Council shall not be considered consecutive if the person seeking the office has not held either office for two years. Section 2.05.050 Prospective Application. Pursuant to Goverrunent Code Section 36502(b), this Ordinance shall only apply to terms of offict~ of Mayor and member of the City Council beginning on or after November 5,1996." SECTION)]: Severability. If any provision of this chapter is held to be invalid and of no force and effect, such invalidity shall not affect other provisions of this chapter which can be enforced without the invalid provision and to this degree, the provisions of this chapter are severable. SECTION III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within 15 days after its passage: in a newspaper of general circulation in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of the adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Goverrunent Code Section 36933.
