OF ORANGE WHEREAS, the Planning Commission heretofore has held a
duly advertised public hearing on the hereinafter described amendment to the Orange
Municipal Code and has recommended to the City Council, by Resolution No, PC
15-96,
approval thereof; and WHEREAS, the City Council adopted Ordinance
No, 16-96 upholding armmdment to Title 17 for the purpose of
regulating
wireless communication antennas;arid WHEREAS, inadvertently, only a portion of the text
was codified by
Ordinance No, 16-96; and WHEREAS, this action will complete the action
intended hy the City Council following their public hearing on this
matter on July 9, 1996,NOW, THEREFORE, the City Council of the City
of
Orange does
ordain as follows:SECTION I:Title 17 of the Orange Municipal Code shall be
amended as specified in Exhibit
A" which
is attached hereto.SECTION II:A summary of this Ordinance shall be published and a
certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk
at least five (5) days prior to the City Council meeting at which this Ordinance is
to be adopted. A summary of this Ordinance shall also be published once within
fifteen (15) days after this Ordinance's passage in a newspaper of general
circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of
copy of the full text of such adopted Ordinance along with the names of those City
Council members voting for and against the Ordinance in accordance with Government
Code Section 36933, This Ordinance shall take effect thirty (30) days from and after the
date of its final passage.

B. Cellular Wireless Communication Antennas
1. Cellular Wireless communication antennas are permitted uses
in OP, CP, Cl, C2, CTR, C3, CR, PI, Ml and M2 districts and shall
be subject to the following:
1. a. Ground Mounted Antennas. Antennas shall be located at
least 100 feet from any residentially zoned property, shall not
exceed 65 feet in height and shall conform to all building
setback requirements. All equipment associated with the
operation of a ground mounted wireless communication
cellular antenna shall comply with development standards for
the zone in which they are located,
2. b. Building Mounted Antennas. Antenna elements may be
placed on buildingfacades or mounted on rooftops. When
located on top of buildings, antennas shall not exceed ten feet
in height, and the combined height of the building and
antenna shall not exceed the height limitations of the
underlying zone. or building approval. If the building itself
exceeds the height limitations of the zone, and such excess
height was legally established (for example, approved by
conditional use permit), then the combined height of the
building and antenna shall not exceed the maximum height
allowed by such approval Support and/or switching
equipment shall be located inside the building, unless it can
be screenedfrom view or as noted below.
All applications for building mounted antennas will require
administrative review by planning staff prior to issuance of
building permits. Planning staff will review antennas for
visual impact, affect on surrounding land uses and potential
safety hazards.
All building and roof mounted antennas, and any associated
externally located support and/or switching equipment, shall
be screened from view or architecturally integrated to blend
in with the design of the building. Screening shall be
achieved either by existing building component, such as
parapet walls, or by screening devices that are compatible
with and complimentary to the architecturalfeatures and
overall design and massing of the building. If staff
determines that a proposal is architecturally compatible with
the existing structure, then it may be approved
administratively. Otherwise the applicant must obtain
approval of the Design Review Board prior to issuance of
building permits.
2. Wireless communication antennas are permitted subject to
issuance of a conditional use permit under the following
circumstances:
a. When ground mounted antennas in the OP, CP, CI, C2,
CTR, C3, CR, PI, MI and M2 districts are located less than
100 feet from any R-3, R-4 or MH zoned property,
from any property in the PC zone that is
designatedfor multiple family use, or from any residentially zoned property
that is developed with a non-residential
use. Antennas shall conform to all building setback
requirements, and all equipment associated with their operation
shall comply with development standards for the zone in
which
they are located.b. In residential
zones as follows:1) On any public or private school
site, park or recreation facility, provided
that any ground mounted antenna is located at
least 100'from any R-
I or R-2 zone.2)
On properties continuing legal non-
conforming commercial developments, provided any ground mounted antenna
is located at least 100 feet

3) In the R-3 and R-4 zones, only on
properties which abut afreeway right of way and are a
minimum of one acre in size, provided that any
ground mounted antenna is located at least 100 feetfrom any
R-l or R-2 zone and is within 100 feet
of any C-l, C-2,
CTR, C-3 or PI zoned property.c. In the RO zone, in
any public or private park or recreation facility,
provided that any ground mounted antenna is located at least
100 feetfrom any R-l or R-2 zone.d.
When building mounted antennas exceed 10 feet in height,
when the combined height of the building and antenna exceeds
the height limitations of the zone, or when the
combined height of the building and antenna exceeds
the limitations of any prior permits approved that
granted additional heightfor the building. All such
antennas, and any associated roof mounted equipment, shall
be architecturally compatible with the building, or shall
be screenedfrom view in

intended for the purpose of receiving communications from orbiting satellite transceivers.

this Title, the term does not include radio and television signals, non-commercial antennas (
such as amateur radio antennas), and non-commercial satellite
