AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING THE
CHAPMAN COLLEGE SPECIFIC PLAN.
WHEREAS, the Chapman College Specific Plan was enacted by the City Council
of the City of Orange by Ordinance No. 4-89;
and WHEREAS, the Planning Commission heretofore has held a duly
advertised public hearing on the hereinafter described amendment to the Chapman College
Specific Plan and has recommended to the City Council, by Resolution No. PC 53-
95, approval
thereof; and Now, therefore, the City Council of the City of Orange does ordain
as follows:
SECTION I:The Chapman College Specific Plan is hereby amended
as follows:A. Real property governed by the Specific Plan is expanded to
include the additional properties described
as follows:Lots 4 and 5 and the east one-half oflot 3 and all oflots 6, 7, 8, 9, 10,
11, 12, 13 and 14, Block "A" ofW.H.H. Clayton's Subdivision ofpart of Richland Farm
Lot 13, in the City of Orange, as per map recorded in Book 4, page 6
of Miscellaneous Maps,records
of Orange County.B. City Council Resolution No. 7233, Specific Plan
Chapter 3.0 Development Regulations) and Chapter 5.0 (Design Guidelines)
shall
include the following:Open Parking Lot Located at Orange Street and Sycamore
Avenue: Along the west side of Orange Street, there shall be a landscaped yard setback a
minimum of two feet in width, shall be landscaped with a solid hedge not less than 30
inches nor more than 42 inches in height. Along the north side of Sycamore Avenue, there
shall be a landscaped yard setback of a minimum eight feet in width with a
solid hedge
as described above.C. City Council Resolution No. 7231 and Specific Plan
Chapter 3.0 Development Regulations) relating to modular units shall be
The maximum density of modular units will be no more than three units north of
Walnut Avenue and no more than six units south of Walnut Avenue. The total number
of modular units within the Specific Plan boundary shall not exceed nine units.
D. City Council Resolution No. 7231 shall be amended to allow expansion of
the Specific Plan boundaries as well as PI Zoning and college uses on the west side of
Orange Street prior to the acquisition by Chapman University of the full block facing
Orange Street.
SECTIONU:
Chapman University will satisfy the following conditions which are hereby
included in the Chapman College Specific Plan:
1. Project shall occur in substantial conformance with the plans and project
description as approved and as modified by conditions herein.
2. Within two days of the final approval of the project, the applicant/owner
shall deliver to the Planning Division a $25.00 cashier's check payable to the County
Clerk to fulfill the County administration fee and enable the City to file the Notice of
Determination required under Public Resource Code Section 21152, 14 Cal. Code of
Regulation 15075. If the applicant/owner has not delivered the required fees within such
two day period, the approval for the project
3. A dedication of land shall be made to the City of Orange to the satisfaction
of the Public Works Director in order to improve Walnut Avenue to its Secondary
Arterial status. The dedication shall be made by an "irrevocable offer of dedication," or
as otherwise approved by the Public Works Director.
4. Prior to the submittal of applications for future amendments to the Specific
Plan, Chapman University shall do a comprehensive update of the Specific Plan for the
sole purpose of incorporating all conditions specified in City Council Resolution No.
7231, 7232 and 7233 and consolidating repetitive language and improving the
document's organization.
S. The applicant shall install trash containers in the parking area. The number
and location shall be determined by Planning staff during the landscape plan check
process.

6. Final review and approval of the landscape and irrigation plans is required
by the City's Design Review Board. Final review of the wall design is also required.
The wall design shall be revised to incorporate more details such as textured or varying
colored pilasters, brick or other material capping, etc.
7. The applicant shall publish a notice in a local newspaper, and post the
properties 15 days prior to the Planning Commission Public Hearing (early November
1995) on the proposed Specific Plan amendment stating that the structures will be for
sale to any interested parties for $1.00 per building. If a structure is to be relocated, the
University shall contribute an amount toward its move that is equal to the cost of
demolition. Persons interested in purchasing and removing said structures must pay all
expenses in excess of the amount contributed by the University, and must complete the
removal within 30 days of the approval of the Specific Plan amendment by the City
Council (mid January 1996) or such further time as the University might allow.
8. The applicant shall create a committee consisting of a representative of
Chapman University, Old Towne Preservation Association, the City of Orange, and the
contractor, to create an inventory of the material to be salvaged.
9. The applicant shall hire a demolition contractor who will agree to salvage
historically significant materials such as doors, windows, hardware, moldings, fixtures,
etc., that can be salvaged with a reasonable amount of effort, and store said materials in a
yard, accessible to interested parties, for a period of at least 30 days to allow purchase of
said materials for the cost of removal. The availability of these items for sale shall be
publicized by newspaper advertisement, and suc:h advertisement shall be placed in a
section of the newspaper other than the "Public Notice" pages.
10. The applicant shall have a qualified photographer photograph the street
with all buildings in place and all individual structures classified S (contributing
structure), with archive quality photos. This shall be done to provide a historical record
of the: neighborhood context and of the structures themselves. The photographs shall be
provided to the historical archives of the Orange Public Library.
11. The on-street parking along the east side of Glassell Street shall
be removed and the shrubs on the property located at the southeast comer of
Sycamore Avenue and Glassell Street shall be modified or removed, to the satisfaction of the City'
s Traffic Engineer, in order to improve traffic visibility at the intersection of Glassell
and

12.. The Chapman University Specific Plan shall be amended to require the
University to hand deliver notification flyers of any future City of Orange public hearing
or public body action to all property owner or resident addresses within 300 feet of the
Specific Plan boundary, or project site if outside the Plan boundaries.
13.. The Chapman University Specific Plan shall be amended to change the
approval process for the placement of modular units. Page 3-6, #13 a) (5) allows
for review and approval by the Community Development Director. This shall be changed
to require that any plan for location of modular units be brought back before the
Planning Commission for hearing as a Major Site Plan
Review.14. Concurrently with construction of the parking lot, Chapman
University shall work with the City Traffic Engineering Division to develop a traffic
management plan, to achieve better utilization of University parking lots and minimize student
parking in the surrounding
neighborhood.SECTION
ill:A summary of this Ordinance shall be published and a certified copy of the
full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5)
days prior to the City Council meeting at which this Ordinance is adopted. A summary of
this Ordinance shall also be published once within fifteen (IS) days after this Ordinance'
s passage in a newspaper of general circulation, published, and circulated in the City
of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of
the full text of such adopted Ordinance along with the names of those City Council
members voting foil' and against the Ordinance in accordance with Government Code
Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of
its final
