AN URGENCY MEASURE OF THE CITY COUNCIL
OF THE CITY OF ORANGE AMENDING CHAPTER
10.42 OF THE ORANGE MUNICIPAL CODE
RELATING TO OFF- STREET PARKING LOTS.
WHEREAS, the City Council of thE' City of Orange has adopted a
comprehensive Ordinance pertaining to privately owned and maintained off-
stn)et parking within the City of Orange as set forth in Orange Municipal Code
Chapter 10.42; and
WHEREAS, that Chapter established a procedure regarding privately
owned and maintained off-street parking facilities within the City of
Orange which are held open for the use of the public for the purpose of vehicle
parking to which sections 22350,23103 and 2310!~ of the California Vehicle Code
apply;
and WHEREAS, the City Council of the City of Orange wishes to add
a newly constructed privately owned and maintained parking lot to
Orange Municipal Code Section10.42.020 to allow the City to enforce certain
sections of the Vehicle Code;
and WHEREAS, the City Council does therefore determine, by a
four-fifths vot'a, that this Urgency Ordinance is necessary for the
immediate preservation of the public health and safety of the community, as the development
known as Century Promenade is scheduled to open to the public, on or
about November
21, 1997.NOW, THEREFORE, THE CITY COUNCIL OF THE
CITY OF ORANGE HEREBY ORDAINS
AS FOLLOWS:
SECTION I:Section 10.42.020 of the Orange Municipal Code is amended to
add
the following:E. That private parking lot known as the
Century Promenade parking lot, and more particularly described as being
bounded on the north by its property limits, on the east by Main Street.
on the south by Katella Avenue, and on the west by the Santa
Ana
SECTION II:
This Ordinance is intended to supersede existing prOVISIOns of the
Orange Municipal Code to the extent those existing provisions are
inconsistent.
SECTION III:
Severability. If any section, subdivision, paragraph, sentence, clause or
phrase of this Chapter is for any reason held to be invalid or unconstitutional,
such decision shall not affect the validity of the remaining portions of this
Chapter. The City Council hereby declares that it would have passed this
Chapter, and each section, subdivision, paragraph, sentence, clause and phrase
thereof, irrespective of the fac:t that anyone (or more) section, subdivision,
paragraph, sentence, clause or phrase had been declared invalid or
unconstitutional.
SECTION IV:
This urgency Ordinance shall take effect immediately in order to protect
the public health, safety and welfare.
SECTION V:
A summary of this urgency ordinance shall be published once
within fifteen (15) days after this urgency ordinance is passed, in a newspaper
of general circulation, published and circulated in the City of Orange. The City
Clerk shall post in the Office of the City Clerk, a certified copy of the full text
of such adopted urgency ordinance along with the names of those City Council
members voting for and against the urgency ordinance in accordance with
Government Code 36933.
