HomeMy WebLinkAboutORD-12-97 Amend Ch 2.20 Officers' Performance BondsORDINANCE NO. 12- 97 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTER 2.20 OF THE ORANGE MUNICIPAL CODE RELATING TO OFFICERS' PERFORMANCE BONDS.WHEREAS, state law permits the City Council to provide a master bond to cover the faithful performance of duties by its employees and officers; and WHEREAS, the City Council finds that current bond amounts required by the Orange Municipal Code are insufficient; and WHEREAS, the City Council finds that a master bond can provide the greatest protection for the City at the least expense.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE HEREBY ORDAINS AS FOLLOWS:SECTION I:Section 2.20.020 of the Orange Municipal Code is hereby repealed in its entirety and replaced with the following:2.20.020 Bonds. The City Clerk, City Treasurer and Director of Finance shall, before entering upon the duties of their respective offices, be covered by a separate bond and/or master official bond covering the faithful performance of the: duties of their respective offices. For the City Clerk, such bond shall be in an amount of no less than $100,000 and for the City Treasurer and Director of Finance, such bond shall be in an amount of no less than $1,500, 000."SECTION II:Severability. If any section, subdivision, paragraph, sentence, clause or phrase of this chapter is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this chapter. The City Council hereby dcclares that it would have passed this chapter, and each scction, subdivision, paragraph,sentcnce, clause and phrase thereof, irrespective of the fact that anyone (or more) section,subdivision, paragraph, sentence, clause or phrase had been declared invalid or SECTION III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage. ADOPTED this 7t-h dayof_~ 1997.
