THE CITY OF ORANGE AMENDING CHAPTER12.58
OF THE ORANGE MUNICIPAL CODE RELATING
TO CLOSURE OF CITY STREETS FOR
SPECIAL EVENTS IN ACCORDANO: WITH THE
CALIFORNIA STATE VEHICLE
CODE.WHEREAS, Vehicle Code Section 2.1101(e) provides that the City
may temporarily close a portion of a City street for special events when, in the opinion of
the local authority, such closing is necessary for the sa.fety and protection of persons
who are to use that street during the temporary
closing;WHEREAS, the City Council does hereby desire to authorize such
street closures by
ordinance.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE HEREBY ORDAINS AS
FOLLOWS:SECTION
I:Section 12.58.015 is hereby added to the Orange Municipal Code to read as
follows:12.58.015 Closure of City Streets for~cial Events. The City Council may,
by resolmion, close portions of City streets for celebrations, parades, and special events
when the Ci1:Y Council determines that such closing is necessary for the safety and protection of
the public who are to use that portion of the street during the temporary closing. The
resolution shall set forth the places and times that said closure will be in effect. The provisions of
the City's Special Event or Special Pageant ordinances shall be met as a condition ofthe
closing,including but not limited, to those relating to liability insurance and security measures,
unless the City is the applicant. A traffic control plan shall be prepared by a registered engineer
for such closure which shall be subject to City review, and the costs of such review shall be
paid for by the applicant. The City Council reserves the right to waive any requirement
proposed herein when it is found to be in the public's interest. The City Council may determine
to limit the number of street closures per year by motllon or
policy."SECTION
II:A summary of this Ordinance shall be published and a certified copy of the full text
of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to
the City Council meeting at which this Ordinance is to be adopted. A summary of
Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage
in a newspaper of general circulation, published, and circulated in the City of Orange. The
City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such
adopted Ordinance along with the names of those City Council members voting for and
against the Ordinance in accordance with Government Code Section 36933. This Ordinance
shall take effect thirty (30) days from and after the date of its final passage.
ADOPTED this 11th day of February 1997
