HomeMy WebLinkAboutORD-02-97 Amend Ch 10.06 City Traffic CommissionORDINANCE NO. 2- 97 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTER 10.06 OF THE ORANGE MUNICIPAL CODE REGARDING THE CITY TRAFFIC COMMISSION.WHEREAS, Chapter 10.06 of the Orange Municipal Code establishes a City Traffic Commission and sets out its duties; and WHEREAS, the State Vehicle Code requires certain traffic regulations to be approved by the "local authority"; and WHEREAS, it is the desire of the City Council to authorize the City Traffic Commission to take act as the "local authority" as that term is used in the State Vehicle Code.NOW, THEREFORE, the City Council of the City of Orange hereby ordains as follows:SECTION I:Section 10.06.080 is hereby amended to read as follows:10.06.080 Duties. The City Traffic Commission is hereby authorized:A. To review and act as specified in the context of this Chapter in matters of traffic and transportation planning. Review, as stated, includes review and consideration of public input, traffic surveys, and recommendations and opinions from the Traffic Engineer's office, Orange Police Department and the Orange Unified School District.B. To review all requests for speed limit increases or decreases and traffic control signals. A public hearing concerning all specific traffic control change must be held at all times.C. To initiate special studies on any unsafe or malfunctioning traffic condition.D. To assist the Staff, Planning Commission, and City Council in short and long range transportation planning within the City, including the review of streets and highways master planning and designation of truck E. To reVIew and answer all complaints concernmg traffic safety conditions. F. To perform such other functions as the City Council may request from time to time. G. To act as the "local authority" as that term is used in the State Vehicle Code for the approval of certain traffic regulations. Action taken by the City Traffic Commission shall be considered final unless appealed to the City Council in accordance with the procedures established below. Additionally, the following action shall be advisory to the City Council and as such for these items, the Commission shall make a report together with recommendations for action to the City Council: A Action involving placement of traffi.c control devices. B. Action involving a matter for which State law requires a decision by the City Council. C. Action involving traffic improvements which have not been previously budgeted. D. Action involving traffic-related modifications to a larger geographic area, as opposed to a single location- specific item. SECTION II:Section 10.06.081 is hereby deleted. SECTION III:Section 10.06.085 is hereby amended to read as follows:Section 10.06.085 Appeals to Citv Council. All acts and determinations of the Traffic Commission are directly reviewable by the City Council which may affirm, reverse or modify any such act or determination as it deems in the best interests ofthe City.A. An appeal from a decision or requirement of the Traffic Commission may be made by any interested party.B. Any appeal from the decision of the Traffic Commission shall be made within fifteen calendar days following the date of the decision of the Commission.C. Appeals shall be in writing.D. The written application for appeal shall state the ground for appeal.E. The original of the appeal shall be filed in duplicate with the Department of Public Works.Ord. No. 2-97 F. If an appeal is requested, th{) same shall be heard in the same manner as prescribed for a public hearing before the Traffic Commission upon notice. SECTION IV: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office ofthe City Clerk a certified copy ofthe full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage.
