98 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ORANGE AMENDING SECTIONS 17.04.020, 17.04.
032,17.18.030, AND 17.18.060 OF THE MUNICIPAL CODE OF
THE CITY OF ORANGE RELATING TO
MASSAGE
ESTABLISHMENTS.NOW, THEREFORE, the City Council of the City of Orange hereby ordains
as
follows:SECTION
I:Section 17.04.020.H of the Orange Municipal Code shall be deleted in its entirety
and Sections 17.04.020.1, 17.04.020.1, and 17.04.020.K shall be renumbered as
Sections I7.04.020.H, I7.04.020.1, and 17.04.020.

II:Section 17.04.032 of the Orange Municipal Code shall be amended to add the
following new definitions between "MARQUEE" and "MAXIMUM LOT
COVERAGE":MASSAGE," Any method of treating the external parts of the body for
remedial,hygienic or any other reason or purpose, whether by means of pressure, rubbing or other
manner of touching external parts of the body with the hands, or with the aid of any mechanical
or electrical apparatus with or without supplementary aids such as oils, powders, creams or
other similar preparations commonly used in this
practice,"MASSAGE ESTABLISHMENT." Any licensed business conducted within the
City wherein any person, for money or any other consideration, administers to another person
a massage or health treatments involving massage as a significant
function,"SECTION
III:The "Massage Parlor" entry in Table 17.18.030 of the Orange Municipal Code shall
be amended to read as
follows:

SECTION IV:
Sections 17.l8.060.M and l7.l8.060.N, 17.18.060.0, and l7.I8.060.P of the Orange
Municipal Code shall be renumbered as Sections 17.l8.060.N, 17.18.060.0, 17.l8,060.P and
l7.l8.060.Q accordingly, and new Subsection 17.l8,060.M shall be added to read as follows:
M. Massage Establishments. All massage establishments shall be conducted in
compliance with Chapter 5.56 of the Orange Municipal Code. When permitted as an accessory
use, massage services shall be integrated within and clearly incidental to the primary use and
income derived from massage services shall not exceed 25% of the business's gross income."
SECTION V:
Should any section, subsection, clause, or provision of this Ordinance for any reason be
held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the
validity or constitutionality of the remaining portions of this Ordinance; it being hereby expressly
declared that this Ordinance, and each section, subsection, sentence, clause and phrase hereof
would have been prepared, proposed, approved and ratified irrespective of the fact that anyone
or more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
SECTION VI:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after its passage in a newspaper of general
circulation in the City of Orange. The City Clerk shall post in the Office of the City Clerk a
certified copy of the full text of the adopted Ordinance along with the names of those City
Council members voting for and against the Ordinance in accordance with Government Code
Section 36933.
