HomeMy WebLinkAboutORD-19-98 Amend Sec 10.18.010 Enformcement of California Vehicle CodeORDINANCE NO. 19- 98 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTIONS 10.18.010 AND10.42.020 OF THE ORANGE MUNICIPAL CODE RELATING TO ENFORCEMENT OF THE CALIFORNIA VEHICLE CODE IN OFF-STREET PARKING LOTS.WHEREAS, the City Council of the City of Orange has adopted two comprehensive Ordinances pertaining to privately owned and maintained off-street roadways and parking lots within the City of Orange as set forth in Orange Municipal Code Sections 10.18.010 and 10. 42.020; and WHEREAS, California Vehicle Code Sections 21107.6 and 21107. 8 establish a procedure for the City Council to apply the California Vehicle Code to private roads which are generally open for public use, within its jurisdiction; and WHEREAS, these Orange Municipal Code Sections have established a procedure regarding such privately owned and maintained off-street roadways and parking facilities within the City of Orange which are held open for the use of the public for the purpose of access to commercial developments and vehicle parking to which the California Vehicle Code would apply; and WHEREAS, the City Council of the City of Orange wishes to change the name of one of these locations, from "The City Center" to "The Block at Orange", to reflect new development; and WHEREAS, the City Council of the City of Orange wishes to add the development known as "Century Promenade" to Section 10.18.010.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE HEREBY ORDAINS AS FOLLOWS:SECTION I:Section IO.I8.01O of Chapter 10.18 of the Orange Municipal Code is hereby deleted in its entirety and replaced with a new Section 10.18.010 to read as follows:10.18.010 Private Roads Serving Commercial Establishments. A. Under the authority of Section 21107.6 of the California Vehicle Code, California Vehicle Code shall apply to those certain privately owned and maintained roads which are generally held open to the public for purposes of vehicular travel to serve commercial establishments as are hereafter designated by ordinance. B. Whenever any ordinance of the City designates or describes a traffic regulation on any privately owned and maintained roads held open to the public for purposes of vehicular travel to serve commercial establishments, the owner or his\her\its representative shall place and maintain signs or markings as required by the California Vehicle Code giving notice thereof, and no such regulation shall be effective unless such signs or markings are in place. C. Whenever authorized signs or markings are placed indicating the traffic regulation, no driver of a vehicle shall disobey any such sign or marking. D. Pursuant to Section 21107.6 of the California Vehicle Code, Subsections A, B, and C of this Section, the provisions of the California Vehicle Code and the following specific vehicle regulations are established: 1. Parking is: a. Prohibited at all times; b. Permitted during certain hours; c. Limited to a maximum of five, fifteen, twenty or thirty minutes or two hours. 2. All vehicles shall stop before entering the intersections controlled by stop SIgnS. 3. On the basis of engineering and traffic surveys, prima facie speed limits are established on those privately owned and maintained roads which provide ingress, egress and circulation within that commercial complex known as "The Block at Orange", and its successors, and on those privately owned and maintained roads which provide ingress, egress and circulation within that commercial complex known as the "Orange Mall", and its successors, and on those privately owned and maintained roads which provide ingress, egress and circulation within that commercial complex known as the Century Promenade", and its successors. 4. Vehicle parking restrictions are established on portions of those privately owned and maintained roads at Saint Joseph Hospital and Children's Hospital of Orange County as the roads and the restrictions affecting them are more specifically set out on a map (Exhibit C) on file in the offices of the City Clerk and the Deparhnent of Public Works. A prohibition of vehicle stopping or parking is established on the private street easement along the northerly boundaries of Lot 4 of that certain Orange County parcel map recorded in the Office of the Orange County Recorder on January 29, 1971, in book 34 at page 28 and on lots 1, 6, 7 and 12 of Parcel Map 89-149. The private street easement lies parallel to the Collins Channel of the Orange County Flood Control District. Said easement is 30 feet wide and extends westerly from Batavia Street to the westerly boundary of Lot 12 of Parcel Map 89-149, a distance of927 feet. SECTION II:Section 10.42.020 ofChapter 10.42 of the Orange Municipal Code is hereby deleted in its entirety and replaced with a newSection 10.42.020 to read as follows:10.42.020 Privately Owned and Maintained FacilitiesnDesignated. The following privately owned and maintained off-street parking facilities within the City are enumerated as being held open for the use of the public for the purpose of vehicular parking and to which Sections 22350, 23103 and 23109 of the California Vehicle Code shall apply:A. That private parking lot known as the Orange Mall, and its successors,parking lot, and more particularly described as being bounded on the north by Heim Avenue, on the east by Tustin Street, on the south by Meats Avenue, and on the west by Canal Street;B. That private parking lot known as The Block at Orange, and its successors,parking lot, and more particularly described as being bounded on the north by Chapman Avenue, on the east by City Drive, on the south by Metropolitan Drive, and on the west by Lewis Street;C. That private parking lot known as the Brunswick Orange Bowl parking lot,the center of which lot is generally located approximately nine hundred ninety (990)feet north of the centerline of Meats Avenue and the westerly boundary of which is located approximately two hundred fifty (250) feet east of the centerline of Tustin Street;D. That private parking lot known as the Shaffer Park Center parking lot generally located on the north side of Grove Avenue bounded on the west by Orange-Olive Road and on the east by Shaffer Street.E. That private parking lot known as the Century Promenade, and its successors,parking lot, and more particularly described as being bounded on the north by its 3 property limits, on the east by Main Street, on the south by Katella Avenue, and on the west by the Santa Ana River Channel. SECTION III: This Ordinance is intended to supersede eXIstIng provisions of the Orange Municipal Code to the extent those existing provisions are inconsistent. SECTION IV: Severability. If any section, subdivision, paragraph, sentence, clause or phrase of this Chapter is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Chapter. The City Council hereby declares that it would have passed this Chapter, and each section, subdivision, paragraph, sentence, clause and phrase thereof, irrespective of the fact that anyone (or more) section, subdivision, paragraph, sentence, clause or phrase had been declared invalid or unconstitutional. SECTION V: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within 15 days after its passage in a newspaper of general circulation in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of the adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
