HomeMy WebLinkAboutORD-12-98 Amend Title 17 Site Plan Review ProceduresORDINANCE NO. 12- 98 AN ORDINANCE OF THE CITY OF COUNCIL OF THE CITY OF ORANGE AMENDING TITLE 17 OF THE ORANGE MUNICIPAL CODE RELATING TO SITE PLAN REVIEW PROCEDURES. RECITALS:After report thereon by the Planning Commission and after due public hearing as required by law, the City Council of the City of Orange has concluded that the following anlendment to Title 17 of the Orange Municipal Code should be adopted:NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Sections 17.10.060.F.2.a. and 17.1O.060.F.2.c. of the Orange Municipal Code shall be dek:ted and Sections 17.060.F.2.b., 17.060.F.2.d., 17.060.F.2.e. and 17.060.F.2.f. shall renumbered as 17.060.F.2.a., 17.060.F.2.b., 17.060.F.2.c. and 17.060.F.2.d., accordingly.SE.CTION II:Section 17.1O.060.F.3.a.iii. of the Orange Municipal Code shall be amended to read as follows:iii. Provide adequate sight distance for drivers at all entrances, exits, drive aisles and roadways, per City Standard Plan 126."SECTION III:Section 17.10.060.F.3.c. of the Orange Municipal Code shall be deleted.SECTION IV:Section 17.1O.060.F.4.a. of the Orange Municipal Code shall be deleted and Sections 17.1lO.060.F.4.b. and 17.1O.060.F.4.c. shall be renumbered as Sections 17.10.060.F.4.a. and 17.1lO.060.F.4.b., SECTIONV:~ Section 17.1O.060.F.5. of the Orange Municipal Code shall be amended to read as follows: 5. Environmental protection: All projects shall be evaluated in accordance willi the provisions of the Califomia Environmental Quality Act." SECTION VI!..; Section l7.1O.060.H. of the Orange Municipal Code shall be amended to read as follows: H. Findings Required. Findings shall be made as follows in conjunction with any project approval. I. That the project design is compatible with surrounding development and neighborhoods. 2. That the project conforms to City of Orange development standards and any applic.able special design guidelines or specific plan requirements. 3. That the project provides for safe and adequate vehicular and pedestrian circulation, both on and off site. 4. That City services are available and adequale to serve the project. 5. That the project has been designed to fully mitigate or substantially minimize adverse environmentall effects." SECTION VIII; Section l7.l8.060.D. of the Orange Municipal Code shall be amended to read as follows: D. Automobile Repair, Minor. General automobile repair, including mechanical repairs, oil change, smog inspection, stereo installalion, tune ups, window tinting, or installation of tires, batteries and accessories, is permitted when the use is conducted entirely within a building on properties which are located more than 100' from any residentially zoned property." SECTION VIII: Section 17.18.070.D. of the Orange Municipal Code shall be amended to read as follows: D. Automobile Repair, Minor. General automobile repair, including mechanical repairs, oil change, smog inspection, stereo installation, tune up, window tinting, or installation of tires, batteries and accessories, when the use is conducted entirely within a building, is permitted subject to issuance of a CUP on properties which are located less than 100' from any residentially zoned property." Ord.12-98 SE!~TION IX: Section 17.34.040 of the Orange Municipal Code shall be amended by adding subsection C. to n:ad as follows: C. Enclosed Parking Stalls. Parking spaces located within a fully enclosed structure may be: counted toward the parking requirement only in the Residential Districts. In all other zoning districts, required parking spaces shall not be located within structures that are or can be fully enclosed in a manner that prohibits access. This section is not intended to prohibit the use of parking structures or covered parking, so long as access to all required parking spaces is provided as required in 17.34.040.A. and B., above." SECTION X: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five days prior to the City Council mee:ting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within 15 days after its passage in a newspaper of general circulation in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of the adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
