99 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING SECTION 10.02.230
OF CHAPTER 10.02 OF THE ORANGE MUNICIPAL
CODE PERTAINING TO THE DEFINITION OF SCHOOL
DAYS.WHEREAS, California Vehicle Code Section 21207 allows the City Council
to establish bicycle lanes;
and WHEREAS, California Vehicle Code Section 21209 allows parking in bicycle
lanes,where permitted;
and WHEREAS, the City Council has previously established an ordinance intending
to prohibit parking in bicycle lanes during the hours children would normally be expected to
be riding their bicycles to and from school;
and WHEREAS, many schools in the City now attend classes at all times during the
year.NOW, THEREFORE, the City Council of the City of Orange does ordain as
follows:SECTION
I:Section 10.02.230 of Chapter 10.02 of Title 10 of the Orange Municipal Code is
hereby amended to read as
follows:School Days: All weekdays of the year excluding federal, state, local and school
holidays.SECTION
II:Severability - Should any sentence, section, clause, part or provision of this ordinance
be declared invalid, the same shall not affect the validity of the ordinance as a whole or any
other part thereof.
SECTION III:

Savings Clause- Neither the adoption of this ordinance nor the amendment hereby of
any other ordinance of this City shall in any manner affect the prosecution for violations of
ordinances, which violations were committed prior to the effective date hereof, nor to be
construed as a waiver of any license or penalty or the penal provisions applicable to any
violation thereof. The provisions of this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City related to the same subject matter, shall be
constructed as restatements and continuations, and not as new enactments.
SECTION IV:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
Ci~y Council meetings at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after this Ordinance's passage in a
newspaper of general circulation, published, and circulated in the City Council members voting
for and against the Ordinance in accordance with Government Code Section 36933. This
Ordinance shall take effect thirty (30) days from and after the date of its final passage.
