mE ORANGE MUNICIPAL CODE TO ADOPT mE
1997 UNIFORM BUILDING CODE, 1997
UNIFORM HOUSING CODE, 1997 UNIFORM
MECHANICAL CODE, 1997 UNIFORM PLUMBING CODE,
1997 UNIFORM CODE FOR THE ABATEMENT
OF DANGEROUS BUILDINGS, 1996
NATIONAL ELECTRICAL CODE, 1997 UNIFORM
SWIMMING POOL CODE AND ornER AMENDMENTS
AND
DELETIONS.NOW, THEREFORE, the City Council of the City of Orange does ordain
as
follows:SECTION
I:Chapter 15.04 of the Orange Municipal Code shall be amended to read as
follows:

Penalties 15.04.010 Adopted by Reference. The City Council adopts by reference,
the I""'"" Uniform Building Code, 1997 Edition, copyright 1997 by the International Conference
of Building Officials, as adopted and amended in the California Building Code, and
said Uniform Building Code is adopted in total as the law of the City except as provided for
in this
chapter.One copy of the Code has been and is now filed with the office of the City
Clerk,and said Code is adopted by reference as if incorporated and set out at length in
this
15.04.020 Fee Schedule. The Uniform Building Code, 1997 Edition, is
amended by deleting Table No. I-A Building Permit Fees, Table A33-A
Grading Plan Review Fees, Table A33-B Grading Permit Fees, and by providing that
fees shall be established by Resolution of
the
City Council.15.04.030 Work Exempt from Permits. Section 106.2 of the
Uniform Building Code, 1997 Edition is amended by adding
the following:12. Free standing concrete or masomy walls not exceeding 42 inches
in height above
finish grade.13. TV dishes and flag poles in connection with a Group R,
Division 3 occupancy and not exceeding 15 feet
in height.14, Playground equipment and similar type
recreational structures.In addition, the following amendments shall be made to existing
subsections of Section
106.2:1. One story detached accessory building used as tool and
storage sheds,playhouses, private lath houses, glass houses, gazebos and similar
structures and us'es, provided projected roof areas does not exceed 150
square feet.2. Wood and chain link fences not
over 6'.11. Prefabricated swimming pools accessory to a Group R,
Division 3 occupanc:y in which the pool walls are entirely above the adjacent grade and
if the capacity does not exceed 5,000 gallons. If pool contains water over 18 inches
deep, a pool barrier shall
be required.15.04.040 Chapter 9 Fire Protection Systems. Amended. For the
purpose of this chapter, the Fire Marshal shall be responsible for plan review, and inspection
of fire protection systems such as fIre sprinklers, fIxed systems installed in grease
hoods and halon systems and detection systems which sense smoke, fIre, heat or
products ofcombustion.
I 15.04.050 Imposition of Stricter Standards. Whenever Chapter15.32,
Uniform Fire Code Section15.32.010 et seq., imposes stricter standards than imposed by
this code, Cbapter15.32, Uniform Fire Code is to
govern.15.04.060 Uniform Building Code CUB C) Appendix. The City Council
adopts by reference the following Appendices of the Uniform Building Code Appendix,
1997 Edition, Copyright 1997 by the International Conference of Building Officials as
adopted Grd No. 13-
and amended in the California Building Code, and said Uniform Building Code
Appendices are adopted in total as the law of the City except as provided for in this
chapter.
Appendix Chapter 4 Division I, with the following changes:
The definition of "Swimming Pool" in Section 420 shall read as follows:
Swimming Pool is any structure intended for swimming or recreational
bathing that contains water over 18 inches deep. This includes in-
ground,aboveground and on-ground swimming pools and
fixed-
in-place wading pools."The first sentence Section 421.1.1
shall read as follows:1. The top of the barrier shall be at least
60 inches above grade measured on the side of the barrier that faces
away
from the swimming pool."Appendix

070 Violations and Penalties.r-- A. It shall be unlawful for any person, finD, or
corporation to erect, construct,enlarge, alter, repair, move, improve, convert or demolish, equip,
use, occupy or maintain any building or structure in the City, or cause the same to be done
or to perform or maintain any grading work or cause the same to be done contrary to,
or in violation of,any of the
provisions of this Chapter.B. Any person, firm, or corporation violating any of
the provisions of this Chapter, shall be deemed guilty of a separate offense for each and
every day or portion thereof during which any violation of any of the provisions of
this Chapter is committed,
continued, or pennitted, and each such offense shall be punishable by a fine of not more
than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six
months, or both such fine and imprisonment.
C. In addition, this Code may be enforced by injunction or other appropriate
civil remedy."

15.08.010 of the Orange Municipal Code shall be amended to read as follows:

Officials, and said Uniform Housing Code is adopted in total as the law of the City
except as provided by this Chapter. One copy of the Code has been and now is filed in
the Office of the City Clerk, and the Code is adopted by reference as if incorporated and
set out at length in this Chapter."SECTION

15.12.010 of the Orange Municipal Code shall be amended to read as follows:

deleting sections 115.2 and115.3 andby providing that fees for the issuance of mechanical
permits, for checking of mechanical plans and for fees for the investigation of work

SECTION V:
Section 15.12.025 of the Orange Municipal Code shall be amended to read as
follows:
15.12.
025 Work Exempt from Permits. Section 112.2 ofthe Uniform Me,chanical
Code, 1997 Edition is amended by adding the following item:6. Replacement
of any appliance of the same type and size and in the same location and in
connection with a Group R, Division 3 occupancy."SECTION VI:

SECTION VII:
Section 15.
16.020 of the Orange Municipal Code shall be amended to read as follows:15.

020 Fee Schedule. The Uniform Plumbing Code, 1997 Edition, is amended by
deleting the schedule of fees contained in Section 103.4 andTable 1-1 and by
providing that fees shall be established by resolution of the City Council.SECTION

16.025 of the Orange Municipal Code shall be amended to read as follows:15.

025 Work Exempt from Permits. Section 103.1.2 of the Uniform Plwnbing Code,
1997 Edition is amended by adding the following:103.1.
2.3 Repairor replacement of any plumbing fixture or appliance of the same type and

SECTION IX:
Sections 15.16.030 and 15.16.040 of the Orange Municipal shall be deleted and
Section 1.5.16.050 shall be renumbered as Section 15.16.030 accordingly.

15.20.010 of the Orange Municipal Code shall be amended to read as follows:

ction 15.24.010 of the Orange Municipal Code shall be amended to read as follows:

24.010 Adopted by Reference. The City adopts by reference the National Electrical
Code, 1996 Edition, published by the National Fire Protection Association NFPA),
and including the "Uniform Administration Provisions for the National Electrical
Code", 1996 Edition published by the International Conference of Building Officials,
pages 1-12, and 70-1 to 70-917 inclusive, as adopted and amended
in the California Building Code, and said Code is adopted in total as the law of the
City except as provided for in this Chapter. One copy of the Code has been and now is filed
in the office of the City Clerk, and said Code is adopted by reference as if incorporated
and set out at length in
this Chapter."
SECTION XII:Section 15.24.020 of the Orange Municipal Code shall be amended to
read
as follows:15.24.020 Fee Schedule. The National Electrical Code, 1996
Edition, is amended by deleting the schedule of fees contained in Table 3-A and
by providing that fees shall be established by resolution of
the
City Council."
SECTION XIII:Chapter 15.25 of the Orange Municipal Code shall

Section 15.48.010 of the Orange Municipal Code shall be amended to read as
follows:

Plwnbing and Mechanical Officials as adopted and amended in the California Building
Code, and said Code is adopted in total as the law of the City except as provided for in
this Chapter. One copy of the Code has been and now is filed in the office of the City
Clerk, and said Code is adopted by reference as if incorporated and set out at length in
this Chapter."
SECTION XIX:
Section 15.48.020 of the Orange Municipal Code shall be amended to read as
follows:

48.020 Fee Schedule. The Uniform Swimming Pool Code, 1997 Edition, is amended
by deleting the schedule of fees contained in Table 3-A and by providing that
fees shall be established by resolution of the City Council. "
SECTION XX:
Chapter 15.56 of the Orange Municipal Code shall be deleted.

SECTION XXI:
Chapter 15.64 of the Orange Municipal Code shall be deleted.
SECTION XXll:
Chapter 15.68 of the Orange Municipal Code shall be deleted.
SECTION XXIll:
Should any section, subsection, clause, or provision of this Ordinance for any
reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality
shall not affect the validity or constitutionality of the remaining portions of this
Ordinance; it being hereby expressly declared that this Ordinance, and each section,
subsection, sentence, clause and phrase hereof would have been prepared, proposed,
approved and ratified irrespective of the fact that anyone or more sections, subsections,
sentences, clauses or phrases be declared invalid or unconstitutional.
SECTION XXIV:
A summary of this Ordinance shall be published and a certified copy of the full
text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days
prior to the City Council meeting at which this Ordinance is to be adopted. A summary
of this Ordinance shall also be published once within fifteen (15) days after its passage in
a newspaper of general circulation in the City of Orange. The City Clerk shall post in the
Office of the City Clerk a certified copy of the full text of the adopted Ordinance along
with the names of those City Council members voting for and against the Ordinance in
accordance with Government Code Section 36933.
