OF THE CITY OF ORANGE AMENDING
CHAPTERS 15,16 AND 17 OF THE MUNICIPAL CODE OF
THE CITY OF ORANGE RELATING TO THE
DESIGN REVIEW
PROCESS.NOW, THEREFORE, the City Council of the City of Orange does ordain
as
follows:SECTION
I:Section15.55.050(b) of the Orange Municipal Code shall be amended to read
as
follows:b) Alterations and Repairs. Alterations and repairs required to meet
the provisions of this chapter shall comply with all other applicable requirements of
the Building Code unless specifically provided for in this chapter. Projects involving
exterior alterations and/or having facade improvements will require Design Review
Committee approval pursuant to Section 15.55. 110(d)
6. "SECTION
II:The definition of "Design Review Approval" in Section 15.55.110(d) of
the Orange Municipal Code shall be deleted and replaced with the
following:DESIGN REVIEW APPROVAL. The building official shall not issue a
permit for construction, exterior alteration, enlargement or demolition of a building or
structure listed on the City's Historic Register without prior approval by the Design
Review Committee during a noticed
hearing. "SECTION
ID:The definition of "Design Review Board" in Section 15.55.110(d) of the
Orange Municipal Code shall be amended to read as
follows:DESIGN REVIEW COMMITTEE. A committee composed of the
Community Development Director or designee and specified professionals appointed by the

which reviews projects within the City's historic districts for compliance with the
established Design Standards in accordance with the Orange Municipal Code."SECTION

15.55. 110(d)2 of the Orange Municipal Code shall be amended to read as follows:2..
Plans
for Seismic Upgrading. Plans for seismic upgrading of contributing and potentially
contributing historical buildings which include external changes and/or facade renovations
shall be reviewed and approved by the Design Review Committee.The purpose
and intent of the plan review shall be to minimize the effects of seismic strengthening on
the exterior appearance of the buildings. The basis of review shall be the Design
Standards adopted by the City and the Secretary of the Interior's Standards,with the
following special arrangements:A. Features
of architectural or historical significance shall be retained and reattached,
braced, or stabilized, as required.B. In-
wall anchors shall be used on the principal facades.C.
Through-wall replica star anchors on other facades may be permitted
provided their locations and treatment are approved by the Community Development
Director and the Chief Building Official.
D. Closure of historic openings on the principal facade shall not be
permitted and shall be discouraged on secondary facades. If closure of such openings on
secondary facades is unavoidable, the materials used shall be compatible with the existing
exterior materials of the secondary facade wall. Insetting of closure materials shall be a
minimum of one inch on the exterior to maintain the fenestration and details of the
building.
E. Historic parapets shall be braced rather than removed.
F. Historic architectural veneer posing a safety hazard shall be
stabilized and re- anchored to the building.
G. When an entire building facade or other entire masonry feature, such
as a wall, cornice, balustrade, column or stairway, must be replaced as too deteriorated to
be repaired within the structural standard of this Chapter, and the use of matching
materials in the replacement feature is not technically or economically feasible, a

compatible substitute material maybe used upon approval of the Community
Development Director and the Chief Building Official. Every effort shall be made to
make such substitute materials as close to matching the original in size, shape, color,
texture, and other observable characteristics as is feasible."SECTION
V:Section
15.55.110(d)5.D.8 of the Orange Municipal Code shall be amended to read
as follows:8.
Design Review Committee recommendation on the replacement structure or use

TION VI:Section
16.04.060 of the Orange Municipal Code shall be amended to read as follows:
16.
04.060 Advisory Agencies. Advisory agencies are charged with the duty of making
investigations and reports on the design and improvement of proposed divisions oK ,
real property and the imposing of requirements or conditions thereon. The Staff eview
Committee and the City Planning Commission are designated as advisory agencies
as that term is used in the Subdivision Map Act and in this title. Subject to the provisions
and according to the procedures of this title, such agencies shall make reports and
recommendations to the City Council on all tentative and fmal tract maps. "SECTION
VII:Sections
16.12.010.A and 16.12.010.B of the Orange Municipal Code shall be amended
to read as follows:A.
A tentative tract map shall be submitted to the Department of Community Development,
accompanied by any forms and fees required by that department. The map sh~~
l be referred to the Staff Review Committee which will review the map and make recommendations
thereon.B.
After the tentative tract map is reviewed by the Staff Review Committee,the:
map shall then be forwarded to the City Planning Commission together with any comments
and/orrecommendations. The City Planning Commission shall review the IIlap
and make recommendations thereon within fifty days of the submittal of the tentative tract
map to the Department of Co~unity Development."3

SECTION VIII:
Section 16.12.010.E of the Orange Municipal Code shall be amended to read as
follows:
E. WiijI respect~ a tentative tract map, the subdivider may appeal from any
action of the staff Review Committee to" the~Citytplanning Commission and taken to the
City Cowlcil pursuant to the procedure set forth in the Subdivision Map Act. "
SECTION IX:
Section 16.12.030 of the Orange Municipal Code shall be amended to read as
follows:
16.12.030 Tentative Parcel Map--StaffReview Committee A1>1>
roval.A. The Staff Reviyw Committee shall have the power of fmal approval of
all tentative parcel maps involving land divisions of four lots or less which meet all
other code and site development requirements and
which:1. Require no zone changes, variances, or conditional use permits;
or 2. Present no other significant difficulties relating to
physical improvements, topography, circulation, access or parcel shape, according to
reasonable engineering and public safety standards as determined by the Staff Review
Committee.B.. All such tentative parcel maps shall be submitted to the Department
of Public Vlorks, accompanied by any forms and fees required by the department. The
map shall be referred to the Staff Review Committee which will review the map and
take action thereon witbID twenty days after the map hasbe.-en accepted for
filing.C. If the tentative parcel map is not approved by the Staff Review
Committee,the subdivider will be notified and given the opportunity to correct the map and
resubmit it to the Committee. In the event that the subdivider wishes to appeal the action taken
by the Committee, he may make an appeal pursuant to this
title.D. If the tentative parcel map is approved by the Staff Review
Committee,pursuant to this section, the subdivider shall be notified by the Department of
Public Works. When a tentative parcel map is required pursuant to this title, the map
as approved or conditionally approved shall expire eighteen months after its approval
or conditional

SECTION X:
Section 16.12.040.B of the Orange Municipal Code shall be amended to read as
follows:
B. All such tentative parcel maps shall be submitted to the Department of

make: a report together with recommendations for acceptance or denial to the City

SECTION XI:
Section 16.12.050.D of the Orange Municipal Code shall be amended to read as
follows:
D. All such tentative maps shall be submitted to the Department of Public
Works, accompanied by any forms and fees required by the department. The map shall
then be referred to the Staff Review Committee for review and the Committee shall make
a report together with recommendations for acceptance or denial to the City Planning
Commission within twenty days after the map has been accepted for filing. The City
Planning Commission shall then have twenty days in which to review and make a report
together with recommendations for acceptance or denial to the City Council. "
SECTION XII:
Section 16.32.040.B and Section 16.32.040.C of the Orange Municipal Code shall
be amended to read as follows:
B. The applicant shall then submit to the Subdivision Section of the
Department of Public Works the application with the other documents listed under
Section 16.32.030 and pay required processing fees. The Subdivision Section shall
review the application and related documents to ensure technical accuracy and acceptable
format for recording. When such determination is made, the Subdivision Section shall set
r-- the application for review at a regularly scheduled meeting of the Staff Review
Committee.
C. The Staff Review Committee shall review the application and related
documents to verify compliance with zoning and land use ordinances and with
established policies and procedures of the City. The Committee shall recommend
approval or disapproval of the application and set the matter on the agenda of the next
re!,'1llarly scheduled meeting of the City Council."

Section 17.08.020.D of the Orange Municipal Code shall be amended to read.as
follows:
D. Design Review Committee. The Design Review Committee is hereby . ......
established to uphold community aesthetics. Recognizing that ". the inclusion of specific
aesthetic development standards is impracticable due to the variable nature of
architectural concepts, construction materials and aesthetic goals from one time period to
another and from one neighborhood to' another, it is in the public interest to establish an
authority for project review.
1. Purpose.
a. To review development projects, by considering the elements
of architectural design, massing and scale, color palette, context, landscapirlg and signage
to ensure: tflat projects are compatible with surrounding development arid community
aesthetics.
b. To interpret and apply adopted 'desigrt guidelines and
standards.
c. To assist in formUlating des~gn policy.
d. T 0 tncourag~ the preservation of cultural historic resources,
while allowing for orderly development.
2. Powers and Duties. The Design Review Committee shall have the
authority to:
a. Make final determination on SIgnS and SIgn programs m
accordance with Chapter 17.36 of this code;
b. Make fmal determination on architectural and landscaping
design matters for minor site plan review applications when referred by Staff Review
Committee'c.
Make fmal determination on architectural and landscaping design
matters for external remodeling of commercial, industrial, institutional and large scale
multiple family developments, except for Minor Site Plan Review projects acted upon
by the Staff Review Committee;Ord

d. Make final determination on architectural and landscaping
design matters for projects in the Old Towne Historic District, when no Planning
Commission review is otherwise required;
e. Review and make recommendations to the Planning Commission
on architectural and landscaping design matters for all development projects and
proposed demolitions requiring Planning Commission recommendation or approval.3.
Meetings. The Design Review Committee shall meet two times a month
as needed. Committee members shall be compensated for each meeting as det<<::
rminedby the City Council.4.
Membership. The Design Review Committee shall consist of the Community
Development Director (or hislher designee) and four (4) members of the public
who shall be appointed by and serve at the pleasure of the City Council. The four appointed
Committee members shall have demonstrated knowledge of, or experience in,the
visual arts, architecture, landscape architecture or similar fields. At least two of the members
shall have professional experience in urban planning, architectural history, or historic
preservation and shall have general knowledge of architectural styles prevalent in Old
Towne. Appointed members of the Committee shall live or work in the City and shall
be appointed for four-year terms. Staff expertise in historic preservation and
landscaping shall be available as a resource to the Committee.
5. Officers/Terms of Office. Officers shall consist of a chairman and
vice-chairman, both of whom shall be selected by the members of the Committee.
Terms of office shall be for one year starting after the second regularly scheduled meeting of
the Committee in April of each year. Each officer must continue to serve until his
successor has been installed. Officers may be reelected for no more than two consecutive
terms.6. Rules and Regulations. The Design Review Committee shall
adopt rules and regulations to provide for the holding of meetings, election of officers,
quorwn and voting provisions, hearings and notices, and may provide for such other matters
as may be in the general welfare of the City subject to approval by the City
Council."SECTION XVII:
Section 17.08. 050.A. of the Orange Municipal Code shall be amended to read as
follows:
A. Right of Appeal. Any action taken by the Community Development
Director, Staff Review Committee, Zoning Administrator, or the Design Review
Committee in the administration or enforcement of the provisions of this chapter may be

appealed
by any person aggrieved, or by an officer, commission or department of the City.
Such appeals- can be made to the Planning Commission. Any action taken by the Planning
Commission may be appealed to the City Council."SECTION

ction 17.08.050.E of the Orange Municipal Code shall be amended to read as follows:
E.
Appeal of Actions Taken by the Community Development Director, Staff Review
Committee, Design Review Committee or the Zoning Administrator.1.
Hearing Date and Notice. Upon receipt of the notice of appeal, the Planning
Division shall set a date for a Planning Commission hearing of the matter and give
noti,ce of the date, time and place of the hearing to the applicant and appellant.Further,
the Planning Division shall give public notice of the hearing as required in Section
17.08.040 at least ten days prior to the date of the hearing. Prior to such hearing,the
Planning Division shall transmit to the Planning Commission a report of the findings and
at such hearing shall present all documents on file.2.
Authority of Planning Commission. The Planning Commission shall consider
the record and such additional evidence as may be offered and may affirm,reverse
or modify, in whole or in part, the action that was appealed. Th.e . Commission may
also make or substitute additional decisions or determinations as it fmds warranted under
the: provisions of this chapter. The Planning Commission shall transmit a copy of the
decision to the applicant, appellant, and the Planning Division. "SECTION

17.10.060.D.2 of the Orange Municipal Code shall be amended to read as follows:

Procedure. Staff Review Committee, as established by Section 17.08.020.E of
this tiitle, shall serve as the reviewing body for minor site plan review. Once an application
for minor site plan review has been deemed complete, the Staff Review Committee
shall consider and approve, approve with conditions, deny or refer the project to
the Design Review Cornmittey and/or the Planning Commission. A continuance may be
grant(~d upon mutual consent of the applicant and Staff Review Committee. Appeals of
Staff Review Committee decisions shall be made in accordance with City appeal procedures,
Section 17.08.050."SECTION

Section 17.10.060.E.2 of the Orange Municipal Code shall be amended to read as
follows:
2. Procedure. Staff Review Committee and Design Review Committee shall
servt~ as the preliminary reviewing bodies for major site plan review. Once an application
for major site plan review has been deemed complete, both the Staff Review Committee
and Design Review Committee shall independently consider and make a recommendation
to approve, approve with conditions, or deny the project. A continuance may be granted
upon mutual consent of the applicant and Staff Review Committee. The
recommendations shall be forwarded to the Planning Commission secretary for placement
on th.e Commission's consent calendar, and shall be noticed as provided for in Section
17.08.040 of this title. Procedures for acting on consent calendar items shall be
established by the Planning Commission and shall be adopted by resolution. The
Commission, in considering a site plan review application, shall review the
recommendations of the Staff Review Committee and Design Review Committee. The
Commission shall act to approve, approve with conditions or deny the application. A
con1inuance may be granted upon mutual consent of the applicant and Planning
Commission. Planning Commission action shall be deemed fmal unless an appeal to the
City Council is filed within fifteen (15) days of the decision in accordance with Section
17.08.050."
SEC:TION XXI:
Section 17.10.060. G of the Orange Municipal Code shall be amended to read as
follows:
G. Conditions of Approval. The Staff Review Committee may recommend or
require reasonable conditions of approval which may include, but not be limited to those
items listed below. The Design Review Committee may recommend conditions of
approval for major site plan review in accordance with Section 17.10.070.E.
1. A revised site plan;
2.Modifications of building height, bulk, mass or scale;
3. Increased setbacks;
4. Division or sound walls;
5. Mitigation of potential project related environmental impacts;

6.
Increased
open space;7. Screening
of parking areas, trash receptacles, mechanical equipment,storage areas;
8. Increased
landscaping;9. Relocation
of buildings;10. Revised
interior circulation or parking area design;11. Off-
site improvements;12.
Revised grading plan; or 13.
Any other changes or additions the Committee feels are necessary to further
the goals of the site plan review process. "SECTION

ction 17.10.070 of the Orange Municipal Code shall be amep.ded to read as follows:
17.
10.070 Design Review.A.
Purpose and Intent. The design review process is established to provide a means
of reviewing development projects to ensure that these projects are compatible with
community aesthetics including architectural design, massing and scale, context,color
palette, signage and landscaping. The design review process serves a primary role in
the implementation of adopted design standards. The City's design objective is to enhance
the community character and identity of the City by promoting diversity,creativity
and cohesiveness in the development of property, building structures, site Jdationships
and landscape through quality design.B.
When Design Review is Required. Design review is r~quired for all projects
listed below:1.
Development

3. Signs as specified in Chapter 17.36;
4. All projects located within a Redevelopment Project Area except
where otherwise exempted by the specific design guidelines adopted for the project area;

All projects within Old Towne or other historic districts as established,
except where otherwise exempted by adopted design standards and/or adopted
specific plan(s);6.
All projects for external remodeling of commercial, industrial,institutional
and large scale multiple family developments, except where otherwise exempted
by City codes, including adopted design standards and/or adopted specific plan(
s).C.
Initiation and Application. Design review applications shall be filed in accordance
with application and submittal requirements as determined by the Design Review
Committee. Application materials may include site, building and landscape plans,
photographs, colored elevations and/or renderings and color and material boards.This
information must be of sufficient detail to allow the reviewing body to determine the compatibility
of the change to the existing structure, area, or district and that the project met~
ts established design standards and criteria. In addition, to comply with provisions of the
California Environmental Quality Act, most projects in historic districts will require an
application for environmental review in accordance with Section 17.08.030. Submittal materials
shall also include information pertaining to scale, massing, streetscape,landscaping
and open space.D.
Design Review Procedure and Criteria. The Design Review Committee shall
make a recommendation or fmal determination as authorized by Section 17.
08.020.D to approve, approve with conditions or deny a project at a public meeting.In
making such recommendation or determination, the Committee shall consider adopted design
standards and guidelines (where applicable), the Secretary of the Interior's Standards
and Guidelines for Rehabilitation (where applicable) and the following general criteria
in making a project determination:r-
The project shall have an internally consistent, integrated design theme which is reflected
in the following elements:1.
Architectural Features.a.
The architectural features shall reflect a similar design style or
period.13

b. Creative building elements and identifying features should be
used to create a high quality project with visual interest and an architectural style.
2. Landscape.
a.
The type, size and location of landscape materials shall support
the project's overall design concept.b.
Landscaping shall not obstruct visibility of required addressing,
nor shall it obstruct the vision of motorists or pedestrians in proximity to the site.
c.
Landscape areas shall be provided in and around parking lots to
break up the appearance of large expanses of hardscape.3.
Signage. All signage shall be compatible with the building(s) design,scale,
colors, materials and lighting.4.
Secondary Functional and Accessory Features. Trash receptacles,storage
and loading areas, transformers and mechanical equipment shall be screened in a manner
which is architecturally compatible with the principal building(s).E.
Conditions of Approval. The reviewing body may require reasonable conditions
of approval to mitigate potential aesthetic impacts of a project. These conditions
may include but are not limited to the following:1.
Modifications to building height, bulk, scale, mass and placement;2.
Changes in building materials and color palette;3.
Screening of parking areas, trash receptacles, storage areas,mechanical
equipment;4.
Changes to the location and use of plants in required landscape areas to
mitigate community concerns;F.
Findings
Required. The reviewing body shall make fmdings for all projects based upon
design criteria stated above. A specific fmding shall be made for projects as follows:Ord

1. In the Old Towne Historic District, the proposed work conforms to
the prescriptive standards and design criteria referenced and/or recommended by the
Design Review Committee or other reviewing body for the project.
2. In any National Register Historic District, the proposed work
complies with the Secretary of the Interior's Standards and Guidelines.
3. The project design upholds community aesthetics through the use of
an internally consistent, integrated design theme and is consistent with all adopted
specific plans, applicable design standards and their required findings.
G. Expiration. If not utilized, project approval expires two years from the
approval date. Extensions of time may be granted in accordance with Section 17.08.060."
SECTION XXIII:
Section 17.12.020.B.1.b of the Orange Municipal Code shall be amended to read
as follows:
b. Building Mounted Antenna. Antenna elements may be placed on building
facades or mounted on rooftops. When located on top of buildings shall not exceed ten
fee1t in height, and the combined height of the building and antenna shall not exceed the
height limitations of the underlying zone. If the building itself exceeds the height
limitations of the zone, and such excess height was legally established (for example,
approved by conditional use permit), then the combined height of the building and
antenna shall not exceed the maximum height allowed by such approval. Support and/or
switching equipment shall be located inside the building unless it can be screened from
view or as noted below. All building and roof mounted antennas, and any associated
externally located and/or switching equipment, shall be screened from view or
architecturally integrated to blend in with the design of the building. Screening shall be
achieved either by existing building component, such as parapet walls, or by screening
devices that are compatible with and complimentary to the architectural features and over
all design and massing of the building. If staff determines that a proposal is
architecturally compatible with the existing structure, then it may be approved
administratively. Otherwise the applicant must obtain approval of the Design Review
Committee prior to issuance of building permits. "

Section 17. 14.060.C.5 of the Orange Municipal Code shall be amended to read as
follows:

Multi-
Tenant Buildings. A sign program for all multi-tenant buildings shall be
requiJred to ensure proper design of signage and adequate identification of building tenants.
Such programs shall provide for consistency in the size, color and placement of signs
within a property and shall be approved by the Design Review Committee.a.
When 60 percent of the tenant wall signs have been changed to conform
to the approved sign program of a multi-tenant building, the remaining tenant
signs shaJI also be changed to conform to the approved sign program.

b. In order to aide the identification of a building or development, the
identification of each building address is required and specified in Title 15.52 of the
Orange Municipal Code. Phone numbers may not be displayed upon a sign (or a
building), in order to avoid confusion and minimize clutter.
c. Sign backgrounds and lettering colors are to be designed with
sufficient contrast so as to be readily legible. "
SECTION XXIX:
Section 17.36.060.A.3.k of the Orange Municipal Code shall be amended to read
as follows:
k. ,Any sign program is subject to initial review and recommendation by
Desiign Review Committee (DRC). Sign applications for individual tenants will be
subject to fmal approval by DRC unless the sign program is specific in describing the
height, width and design components of signs for each tenant space."
SECTION XXX:
Should any section, subsection, clause, or provision of this Ordinance for"~y
reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality
shan not affect the validity or constitutionality of the remaining portions of this
Ordinance; it being hereby expressly declared that this Ordinance, and each section,
subsection, sentence, clause and phrase hereof would have been prepared, proposed,
approved and ratified irrespective of the fact that anyone or more sectioils,subs~ctions,
sentences, clauses or phrases be declared invalid or unconstitutional.
SECTION XXXI:
A

of this Ordinance shall-be published and,a certified copy of the full text

to the City Council meeting at which this Ordinance is to be adopted. A summary of
this Ordinance shall also be published once within fifteen (15) days after its passage in a
newspaper of general circulation in the City of Orange. The City Clerk shall post in the Office
of the City Clerk a certified copy of the full text of the adopted Ordinance along with
the names of those City Council members voting for and against the Ordinance in accordance
with Government Code Section 36933.17
