AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ORANGE AMENDING SECTIONS 17.14.060, 17.18.030, and
17.18.070 OF THE ORANGE MUNICIPAL CODE RELATING
TO BED AND BREAKFAST INNS IN CERTAIN
COMMERCIAL ZONING DISTRICTS.
RECITALS:
After report thereon by the Planning Commission and after due public hearing as requiredbylaw, the City Council of the City of Orange has concluded that the following amendments toTitle17oftheOrangeMunicipalCodeshouldbeadopted:
NOW, THEREFORE, the City Council of the City of Orange hereby ordains asfollows:
SECTION I:
Section 17. 14.060.C of the Orange Municipal Code shall be amended to read as follows:
C. Bed and Breakfast Inn.
1. Only historic structures will qualify for use as a Bed and Breakfast Inn.Historic significance shall be identified by prior listing in the City's historic building survey,individual listing as a contributing structure within the Old Towne Historic District, or by aHistoricAmericanBuildingSurvey ("HABS": an evaluation of the building's historic qualitiespreparedbyanarchitectorotherprofessionalconsultantandsubmittedforreviewbycitystaffandthePlanningCommission.)
2. An owner, manager, proprietor or caretaker of the property must reside onthesubjectpremisesatalltimes.
3. No cooking facilities shall be permitted in any guest room.
4.
Guest meals shall be served only to persons registered as overnight guests.5.
No guest shall be permitted to rent accommodations or remam m occupancy
for a period exceeding 14 days during any 90-day period."
SECTION II:
The "Residential Uses" section of Table 17.18.030 ofthe Orange Municipal Code shall beamendedtodeletethefollowinguse:

Lodging Services" section of Table 17.18.030 of the Orange Municipal Code shall be

17 .18.070.H of the Orange Municipal Code shall be amended to read as follows:H.

V:Should
any section, subsection, clause, or provision of this Ordinance for any reason be held
to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity
or constitutionality ofthe remaining portions of this Ordinance; it being hereby expressly declared
that this Ordinance, and each section, subsection, sentence, clause and phrase hereof Ord

would have been prepared, proposed, approved and ratified irrespective of the fact that anyone
or more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
SECTION VI:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after its passage in a newspaper of general
circulation in the City of Orange. The City Clerk shall post in the Office of the City Clerk a
certified copy of the full text of the adopted Ordinance along with the names of those City
Council members voting for and against the Ordinance in accordance with Government Code
Section 36933.
