AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ORANGE AMENDING CHAPTER 15.60 OF THE
MUNICIPAL CODE OF THE CITY OF ORANGE
RELATING TO FLOOD DAMAGE PREVENTION.
NOW, THEREFORE, the City Council of the City of Orange does ordain as
follows:
SECTION I:
The definition of "Lowest Floor" in Section 15.60.050 of the Orange
Municipal Code shall be amended to read as follows:
LOWEST FLOOR means the lowest floor of the lowest enclosed area (including
basement.) An unfinished or flood resistant enclosure, usable solely for parking of
vehicles, building access or storage in an area other than a basement is not considered a
building's lowest floor; provided that such enclosure is not built so as to render the
structure in violation of the applicable nonelevation design requirements of this Chapter.
Note: This definition allows attached garages to be built at grade. Below grade garages
are not allowed as they are considered to be basements.)"
SECTION II:
Section 15.60.070 of the Orange Municipal Code shall be amended to read as
follows:
15.60.070 Basis for Establishing the Areas of Special Flood Hazard. The areas
of special flood hazard identified by the Federal Insurance Administration of the Federal
Emergency Management Agency in the Orange County and incorporated areas Flood
Insurance Study (FIS) dated January 3, 1997, and accompanying Flood Insurance Rate
r--. Map (FIRM), dated January 3, 1997, and all subsequent amendments and/or revisions, are
hen~by adopted by reference and declared to be a part of this ordinance. This FIS, with its
attendant mapping, is the minimum area of applicability of this ordinance and may be
supplemented by studies for other areas that allow implementation of this ordinance and
are recommended to the City Council by the Floodplain Administrator. The FIS and
FIRM are on file at the City Hall, 300 East Chapman Avenue, Orange, California,
92688."
SECTION III:
Section 15.60.160 of the Orange Municipal Code shall be amended to read as
follows:
15.
60.160Standard of Construction. In all areas of special flood hazards, the following
standards are required:A.
Anchoring.1.
All new construction and substantial improvements shall be adequatdy
anchored to prevent flotation, collapse or lateral movement of the structure resulting
from hydrodynamic and hydrostatic loads~ including the effects of buoyancy.2.
All manufactured homes shall meet the anchoring standards of Section
15.60.190.B.
Construction Materials and Methods. All new construction and substantial improvement
shall be constructed as follows:1.
with materials and utility equipment resistant to flood damage;2.
using methods and practices that minimize flood damage;3.
with electrical, heating, ventilation, plumbing and air conditioning equipment
and other service facilities that are designed and/or located so as to prevent water
from entering or accumulating within the components during conditions of flooding:;
and 4.
if within Zones AH or AO, so that there are adequate drainage paths around
structures on slopes to guide flood waters around and away from proposed structures.
C.
Elevation and Floodproofing. (See Section 15.60.050 definitions for LOWEST
FLOOR", "NEW CONSTRUCTION", "SUBSTANTIAL DAMAGE" and SUBST
ANTIAL IMPROVEMENT".)1.
Residential construction, new construction or substantial improvement,
shall have the lowest floor, including basement:Ord

a. in an AO Zone, elevated above the highest adjacent grade to a
height exceeding the depth number specified in feet on the FIRM, by at least one foot, or
elevated at least three feet above the highest adjacent grade if no depth number is
specified.
b. in an A Zone, elevated at least one foot above the base flood
elevation, as determined by this community.
c. in all other Zones, elevated at least one foot above the base
flood elevation.
Upon the completion of the structure, the elevation of the lowest floor
including basement shall be certified by a registered professional engineer or surveyor, or
velified by the community building inspector to be properly elevated. Such certification
or verification shall be provided to the Floodplain Administrator.
2. Nonresidential construction shall either be elevated to conform with
Seetion 15.60.160.C.l, or together with attendant utility and sanitary facilities,
a. be floodproofed below the elevation recommended under
Se(~tion 15.60.160.C.l so that the structure is watertight with walls substantially
impermeable to the passage of water;
b. have structural components capable of resisting hydrostatic
and hydrodynamic loads and effects of buoyancy; and
c. be certified by a registered professional engineer or architect
that the standards of this Section 15.60.160.C.2 are satisfied. Such certification shall be
provided to the Floodplain Administrator.
3. All new construction and substantial improvement with fully
enclosed areas below the lowest floor (excluding basements) that are usable solely for
parking of vehicles, building access or storage, and which are subject to flooding, shall be
designed to automatically equalize hydrostatic flood forces on exterior walls by allowing
for the entry and exit of floodwater. Designs for meeting this requirement must exceed
the following minimum criteria:
a. be certified by a registered professional engineer or architect;
or

b.
approved by the Federal
Agency; or
be certified to comply with a local floodproofing standard
Insurance Administration, Federal Emergency Management
c. have a minimum of two openings having a total net area of
not less than one square inch for every square foot of enclosed area subject to flooding.
The bottom of all openings shall be no higher than one foot above grade. Openings may
be equipped with screens, louvers, valves or other coverings or devices provided that they
permit the automatic entry and exit of floodwater.

Manufactured homes shall also meet the standards In Section 15.

IV Section
15.60.230.F of the Orange Municipal Code shall be amended to read as follows:

The Floodplain Administrator will maintain a record of all variance actions,including
justification for their issuance, and report such variances issued in its biennial report
submitted to the Federal Insurance Administration, Federal Emergency Management
Agency."SECTION
V Section
15.60.240 of the Orange Municipal Code shall be amended to add new subsections
G. and H. to read as follows:G.
Upon consideration of the factors set forth in Section 15.60.230.C and the purpose
of this ordinance, the legislative body may attach such conditions to the granting of
variances as it deems necessary to further the purposes of this ordinance.H.
Any applicant to whom a variance is granted shall be given written notice, over the
signature of a community official, that the issuance of a variance to construct a structure
below the base flood level will result in increased premium rates for flood insurance
up to amounts as high as $25 for each $100 ofinsurance coverage."SECTION
VI:Should
any section, subsection, clause, or provision of this Ordinance for any reason
be held to be invalid or unconstitutional, such invalidity or unconstitutionality OrdNo.

shall not affect the validity or constitutionality of the remammg portions of this
Ordinance; it being hereby expressly declared that this Ordinance, and each section,
subsection, sentence, clause and phrase hereof would have been prepared, proposed,
approved and ratified irrespective of the fact that anyone or more sections, subsections,
sentences, clauses or phrases be declared invalid or unconstitutional.
SECTION VII:
A summary of this Ordinance shall be published and a certified copy of the full
text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days
prior to the City Council meeting at which this Ordinance is to be adopted. A summary
of this Ordinance shall also be published once within fifteen (15) days after its passage in
a newspaper of general circulation in the City of Orange. The City Clerk shall post in the
Office of the City Clerk a certified copy of the full text of the adopted Ordinance along
with the names of those City Council members voting for and against the Ordinance in
accordance with Government Code Section 36933.
