AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ORANGE REVISING FEES FOR CITY
SANITATION SERVICES AND AMENDING
CHAPTER 13.60 OF THE ORANGE MUNICIPAL
CODE.
WHEREAS, Health and Safety Code Section 5471 authorizes the City, by ordinance, to
revise fees for services and facilities furnished by it in connection with its sanitation, storm drain or
sewer systems; and
WHEREAS, the City Council of the City of Orange desires to revise the fee charged for
City sanitation services for sewer cleaning, street sweeping, storm drain maintenance, litter pick-
up,street tree maintenance and code enforcement costs;
and WHEREAS, the City Council of the City of Orange finds and determines that due to
the increases in contractual costs to provide such services the proposed fees are reasonable and do
not exceed the estimated costs of providing the services;
and WHEREAS, the City Council of the City of Orange finds that the fees established
in Chapter 13.60 of the Orange Municipal Code should be set forth in the City's Master Schedule
of Fees and Charges to avoid confusion and having to modify the codified Orange Municipal
Code every time a new rate is
adopted.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE ORDAINS AS
FOLLOWS:SECTION
I:Section 13.60.015 of the Orange Municipal Code shall be deleted in its entirety andreplacedwiththe
following:
13.60.015 Settini and Revisin~ Fees. Fees for the City's sanitation and sewage system
shall be set forth by ordinance in accordance with Health and Safety Code Section 5471 and included
in the City's Master Schedule of Fees and Charges. Fees for solid waste collection and disposalservicesshallbesetforthbyresolutioninaccordancewithPublicResourcesCodesection40059and
included in the City's Master Schedule of Fees and Charges."
SECTION II:
Sections 13.60.020, 13.060.030 and 13.60.040 of the Orange Municipal Code shall be
deleted in their entirety. Sections 13.60.050, 13.60.060, 13.60.070, 13.60.080 and 13.60.090,
respectively, shall be renumbered 13.60.020, 13.60.030, 13.60.040, 13.60.050 and 13.60.060
SECTION III:
The monthly fee for City sewer cleaning, street sweeping, storm drain maintenance, litter
pick-up, street tree maintenance and code enforcement costs related to such services shall
be increased as set forth in the rate schedule summary attached as Exhibit "A", entitled "Other
CitySanitationServices".
SECTION IV:
The fee set forth in this Ordinance shall not be codified, but shall be set forth in the City's
Master Schedule of Fees and Charges.
SECTION V:
A summary of this Ordinance shall be published and a certified copy of the full text of this
Ordinance shall be posted in the Office of the City Clerk at least five days prior to the City Council
meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be
published once within 15 days after its passage in a newspaper of general circulation in the City of
Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of
the adopted Ordinance along with the names of those City Council members voting for and against
the Ordinance in accordance with Government Code Section 36933.

CITY SANITATION SERVICES The
City furnishes to its residents, businesses and industrial clients, sewer cleaning, street sweeping,
storm drain maintenance, litter pick up, street tree maintenance, code enforcement costs
related to such service, and other services to provide a clean and healthful environment.For
such services and facilities, the following charges are fixed to premises to which a sewer main
is available.A.
Single-family dwelling, $5.34 per month.
B. Single-family dwelling units in any duplex, double house, and other
buildings containing only single-family dwelling units, $5.34 per month
per unit.c. Apartment house, $5.99 per unit per month where bin service isutilized; $5.34 per unit per month where bin service is not utilized. When the Director of Public
Works determines that it is not reasonably possible to place a trash bin at an active water meter service
for a building generating trash in excess of five 45-gallon containers per week, the
charge for each unit of such multiple-family building shallbe an additional $5.34
per month per unit.D. Hotel, motel, bungalow court, or auto court, $5.99 per month
for each dwelling unit herein with cooking facilities where bin service utilized; $5.34 per month
where bin
service is not utilized.E. Hotel, motel, bungalow court or auto court, $1.24 per month
for each dwelling unit with private toilet facilities only, other than a dwelling unit described
in Subsection D above.F. For each water closet in any hotel, motel, bungalow court, or auto
court other than a water closet in any dwelling unit in Subsections D and E hereof, the sum of $
5.99 per water closet where bin service is utilized, $5.34 per month where bin
service is not utilized.G. Rooming house, $5.34 per month, together with $1.24 per month
for
each rented room.H. Clubhouse, equipped with sanitary plumbing facilities, $5.99 per month
for one water closet where bin service is utilized, $5.34 per month where bin service is not utilized,
and $1.24 per month for each
additional
water closet.

OTHER CITY SANITATION SERVICES
I. For each office situated in any building where bin service is utilized, $5.99 per month,
where bin service is not utilized, $5.34 per month.
J. Trailer camps or trailer parks, $5.34 per month for each trailer space, provided that if
any such trailer camp or trailer park utilizes bin service, rate shall be $5.99 plus $1.24 per month
for each trailer space.
K. For all other premises not specifically mentioned in this section where such premises
are occupied by one or more persons, or is used for commercial, professional, manufacturing, or
processing purposes with sanitary plumbing facilities, $5.99 where bin service is utilized, where
bin service is not utilized $5.34 per month, plus $1.24 per month for each additional water
closet.
L. For condominiums and townhouses with individual water meters and utilizing bin
service, $5.20 per month per unit, where bin service is not utilized $5.34 per month per unit.
M. For all other purposes not specifically mentioned in this section and do not utilize
trash service from the City's Contractor, $5.34 per month per unit.
