HomeMy WebLinkAboutORD-07-00 Reapeal & Add Ch 2.60 Park Planning & Development CommissionRECITALS: ORDINANCE NO. 7-00 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE REPEALING CHAPTER 2.60 OF THE ORANGE MUNICIPAL CODE AND ADDING NEW CHAPTER 2.60 TO THE ORANGE MUNICIPAL CODE RELATING TO THE PARK PLANNING AND DEVELOPMENT COMMISSION. After due public hearing as required by law, the City Council of the City of Orange has conduded that the following changes to the Orange Municipal Code should be adopted: NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: Chapter 2.60 of the Orange Municipal Code is hereby repealed in its entirety and a new Chapter 2.60 is hereby added to the Orange Municipal Code to read as follows: r". Sections: 2.60.010 2.60.020 2.60.030 2.60.040 2.60.050 2.60.060 2.60.070 2.60.080 2.60.090 2.60.100 Chapter 2.60 Park Planning & Development Commission Established. Powers and Duties. Appointments and Terms. Election of Officers Regular Meetings. Special Meetings. Quorum- Voting.Absence of Members.Action of Members- Authority Required.Communications from 2.60.010 Established. There is established in the City a Park Planning and Development Commission consisting -of five members, to further the following goals:2. 60.020 2. 60.030 A. Implement park planning, design and development policies as outlined in the Master Plan of Parks;Develop and implement strategies to solicit community and special interest groups' regular input regarding park acquisition and facility needs;Review park conceptual designs prior to development and receive public input;Review existing parks for possible renovation and use, and receive public input;and Encourage and support relationships with volunteer and non-profit organizations regarding parks, facilities and open space. B. C. D. E. Powers and Duties. The Commission shall have the following powers and duties: A.Advise and make recommendations concerning the implementation of the City's Master Plan of Parks; Advise and recommend to the City Council the acquisition of new park land; Advise and recommend to the City Council the conceptual design of new park land; Advise and recommend to the City Council the allocation of new park land between passive and active parks; Advise and recommend to the City Council the renovation of current park land; and Perform such other duties as may be prescribed by the City Council. B. C. D. E. F. Appointments and Terms. Members of the Commission shall be appointed by the Mayor, subject to the advice and consent of the City Council. Members shall serve for a term of three years. However, the initial ternlS of two members of the original Commission shall be two years as determined by the City -C01mcil. 2. 60.040 Election of Officers.The Commission shall elect at its first meeting in July of every year, from its members, a Chairman and a Vice Chairman. The terms of office for these officers shall be one year.Ord. No. 7-00 2 MEB 2.60.050 2. 60.060 Regular Meetings.A. The Park Planning & Development Commission shall meet in regular session on dates and at times to be determined from time to time by the Commission and approved by the City Council;Any regular meeting date so established shall be advertised by a notice of such regular meeting date published only on one single occasion after establishment in a newspaper of general circulation and by any additional means the City Council deems appropriate. All meetings shall be open to the public, and provisions of the Brown Act shall apply;If any regular meeting date should fall on a holiday, the same day in the following week shall be designated as the meeting day.B. C. Special Meetings.A special meeting may be called by the Chairman or upon written request of at least three members. 2. 60.070 Quorum-Voting. A majority of at least three members shall constitute a quorum. A majority vote of the members present shall be required to carry a motion or other procedure governing the operation of the Commission; provided, however, that all recommendations to the City Council must have the approval of at least three members. 2.60.080 Absence of Members. Absence from three consecutive meetings without formal consent of the Commission will be deemed to constitute the resignation of such member, and the position is declared vacant. 2.60.090 Action by Members- Authority Required. No member shall take any action or make any statement committing the Commission unless given express authority to do so by a majority vote of the Commission's entire five members. Ord. No. 7-00 3 2.60.100 Communications from the Commission. A. No member of the Commission, nor the Commission as a body, shall gIve direction to any member of the Staff, except a Minute Secretary, if such is provided.B. All recommendations of the Commission to the City Council for its consideration and action shall be transmitted in writing.C. All other written communications from the Commission shall be sent over the signature of an officer ofthe Commission or the Secretary, if one is designated."SECTION II:Should any section, subsection, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions ofthis Ordinance; it being hereby expressly declared that this Ordinance, and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, approved and ratified irrespective of the fact that anyone or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION III:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage.ADPOPTED this 25th day of April 2000.Ord.
