01 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING CHAPTER 3.08
OF THE ORANGE MUNICIPAL CODE RELATING
TO THE CITY'S PURCHASING
SYSTEM.WHEREAS, the City has adopted a purchasing system for the procurement
of professional services;
and VVHEREAS, the purchasing system requires all professional services agreements
in excess of $30,000 to be approved by the City Council;
and VHEREAS, under the current system the City Council must approve
any modifications to the dollar amount of any professional services contracts it approves
which can sometimes delay timely performance of the contracts;
and VHEREAS, the City Council finds that it would be in the best interests of the City
to authoriz,e the City Manager to approve limited increases in the dollar amount of
professional services
contracts.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE DOES ORDAIN AS
FOLLOWS:SECTION
I:Section 3.08.410 of the Orange Municipal Code is deleted in its entirety and
replaced with the
following:3.08.410 Professional Services--General
Bid Limits.A. Professional selvices of five hundred dollars ($500.00) but not more
than two thousand dollars ($2,000.00) require a purchase order with the approval
of the initiating
department head.B. Professional services of two thousand dollars ($2,000.00) but not
more than thirty thousand dollars ($30,000.00) require approval of the
initiating department head and the
City Manager.C. Professional services in excess of thirty thousand dollars ($30,000.
00) require the approval of the
SECTION II:
Section 3.08.430 of the Orange Municipal Code is deleted in its entirety and replaced
with the following:
3.08.430 Professional Services--
Approvals.All contracts for professional services with a value of two thousand
dollars 2,000.00) or less shall be approved by the initiating department head
and executed by purchase order. All contracts for professional services with a
value between two thousand dollars ($2,000.00) and thirty thousand
dollars 30,000.00) shall have the prior approval of, and be executed by, the
City Manager and shall be approved as to form by the City Attorney. All
contracts for professional services in excess of thirty thousand dollars ($30,000.00)
shall require the approval ofthe City Council and shall be executed by the Mayor
and approved as to form by the City Attorney. Unless the agreement
provides otherwise, the City Manager may approve dollar increases in
professional services agreements that have been approve:d by the City Council. The extent
of the City Manager's authority to approve such increases shall be in the amount
of 10,000 or 10 percent, whichever is greater. However, in no event may the
City Manager approve an increase of more than $30,
000."SECTION
III:A summary of this Ordinance shall be published and a certified copy of the full text
of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to
the City Council meeting at which this Ordinance is to be adopted. A summary of
this Ordinance shall also be published once within fifteen (15) days after this Ordinance's
passage in a newspaper of general circulation, published, and circulated in the City of Orange.
The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of
such adopted Ordinance along with the names of those City Council members voting for
and against the Ordinance in accordance with Government Code Section 36933. This
Ordinance shall take effect thirty (30) days from and after the date of its final
passage.ADOPTED this 13th day of November,
