OF THE CITY OF ORANGE AMENDING
CHAPTER 16.35 OF TITLE 16 OF THE
ORANGE MUNICIPAL CODE TO PROVIDE FOR
THE PROCESSING OF VESTING TENTATIVE
MAPS FOR NON-
RESIDENTIAL
SUBDIVISIONS.RECITALS:After due public hearing as required by law, the City Council of the
City of Orange has concluded that the following changes to the Orange Municipal
Code should
be adopted:NO~W THEREFORE, THE CITY COUNCIL OF' THE CITY OF

AS FOLLOWS:
SECTION I:Section 16.35.040 of the Orange Municipal Code is hereby amended to
read
as follows:16.35.
040 Definitions.A. VESTING TENT A TIVE MAP. A tentative map for a
residential or non-residential subdivision, as defined in other
provisions of Title 16 of this code, that shall have printed conspicuously on
its face the words "Vesting Tentative Map" at the time it is
filed in accordance with Section 16.35.060, and is thereafter
processed in accordance with
the provisions hereof.B. All other definitions set forth in the Title 16 of
this
Code are
applicable.SECTIONII:Section 16.35.050 of the Orange Municipal Code is hereby amended
to
read as follows:16.
35.050 Application.A. This chapter shall apply to
residential and non-residential developments. Whenever a provision of
the Subdivision Map Act,as implemented and supplemented by other provisions
this code, requires the filing of a tentative map or tentative parcel
map for a residential or non-residential development, a
vesting tentative map may instead be filed, in accordance with
the provisions
hereof.B. If a subdivider does not seek the rights conferred by the
Vesting Tentative Map Statute, the filing of a vesting tentative map shall
not be a prerequisite to any approval for any proposed
subdivision,permit for construction, or work preparatory to
construction.SECTION
III:Should any section, subsection, clause, or provision of this Ordinance foranyreasonbeheldtobeinvalidorunconstitutional, such invalidity orunconstitutionalityshallnotaffectthevalidityorconstitutionalityoftheremainingportionsof
this Ordinance; it being hereby expressly declared that this Ordinance, and each
section,subsection, sentence, clause and phrase hereof would have been prepared, proposed,approved and ratified irrespective of the fact that anyone or more sections,
subsections,sentences, clauses or phrases be declared invalid or
unconstitutional.SECTION
IV:A summary of this Ordinance shall be published and a certified copy of the
full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is adopted. A summary of
this Ordinance shall also be published once within fift:een (15) days after this Ordinance'
s passage in a newspaper of general circulation, published, and circulated in the City
of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of
the full text of such adopted Ordinance along with the names of those City Council
members voting for and against the Ordinance in accordance with Government Code
Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its
final pass.
