HomeMy WebLinkAboutORD-10-01 Amend Sec 2.04- Decorum at City Council MeetingsORDINANCE NO. 10- 01 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SECTION 2.04. 210 AND 2.04.220 OF THE ORANGE MUNICIPAL CODE AND ADDING SECTION 2.04.270 TO THE ORANGE MUNICIPAL CODE RELATING TO DECORUM AT CITY COUNCIL MEETINGS.WHEREAS, the City Council is authorized to enact regulations to promote the orderly conduct of its meetings; and WHEREAS, the City Council is authorized to impose penalties against persons who intentionally disrupt its meetings.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Sections 2.04.210 and 2.04.220 of the Orange Municipal Code are deleted in their entirety and replaced with the following:1;'2.04.210 Decorum. A. By Council Members. While the Council is in session, the members must preserve order and decorum, and a member shall neither, by conversation or otherwise, delay or interrupt the proceedings of the peace of the Council nor disturbanymemberwhilespeakingorrefusetoobeytheordersoftheCounciloritspresiding officer,except as otherwise provided in this chapter.B. By Persons. Each person addressing the Council shall not make personal,impertinent, slanderous, or profane remarks to any member of the Council, staff, or general public. Any person who makes such remarks, or who utters loud, threatening, personal or abusive language, or engages in any other conduct which disrupts, disturbs or otherwise impedes the orderly conduct of any Council meeting shall, at the discretion of thepresidingofficer, be barred from further audience before the Council during that meeting, unless permission to continue is granted by a majority vote of the Council.2:.04.220 Enforcement of Decorum. The Chief of Police, or such member or members of the Police Department as the presiding officer may designate, shall beSergeant-at-Arms of the Council meetings and be responsible for enforcing the rules of decorum as set forth above. The Sergeant-at-Arms shall carry out all orders and instructions given by the presiding officer for the purpose of maintaining order and decorum at the Council meeting.Upon instructions of the presiding officer, it shall be the duty remove from the meeting any person who violates the order and decorum of the meeting and take any other action as necessary, including arrest." SECTION II: Section 2.04.270 of the Orange Municipal Code is added to Chapter 2.04 to read as follows: 2.04.270 Penalty for Violation. Any person violating the provisions of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than $1,000.00 or by imprisonment in the County Jail for a term not exceeding six months or both such fine and imprisonment." SECTION III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
