01 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING SECTION 17.04.
023 AND CHAPTER 17.36 OF TITLE 17 OF
THE ORANGE MUNICIPAL CODE PERTAINING
TO REGULATIONS FOR DECORATIVE
BANNERS.WHEREAS, Title 17 of the City of Orange Municipal Code sets forth the City'
s regulations governing signs and banners;
and WHEREAS, the purpose of this ordinance is to provide new standards for
decorative banners in Title 17 of the City of Orange Municipal
Code.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE
DOES ORDAIN AS
FOLLOWS:SECTION
I:The definition of "DECORATIVE BANNER" is hereby added to Section 17.04.023
of the Orange Municipal Code to read as
follows:DECORATIVE BANNER - A lightweight, flexible colored fabric of any size or
material, not exceeding 24 square feet in area and attached singly or in pairs to
utility poles or street light standards, which are used to identify, promote or
advertise a commercial or industrial district or a festival, spectacular or other
similar event of a general civic or public nature, or to complement the visual
appearance of a commercial or industrial district: but which do not contain written
advertising copy. See Section 17.36.150 for applicable regulations."
SECTION II:
Subparagraph C of Section 17.36.050 of the Orange Municipal Code is hereby amended
to read in full as follows:
C.
Utility Poles/Street Lights. Except as otherwise permitted in Section 17.
36.150, no sign shall be placed or maintained, in any manner, on any utility pole
or street light standard or their appurtenances, except for operational notices placed
by the utility that owns said utility pole or street light standard."
SECTION III:
A new subparagraph H is hereby added to Section 17.36.150 of the Orange Municipal
Code to read as follows:
H. Decorative banners. Decorative b,mners shall be permitted only in
commercial or industrial districts and only as part of a sign program developed
and sponsored by the City or its redevelopment agency and approved by the
Community Development Director (or his or her designee), in which case such
public bodies shall be exempt from the payment of any permit fee. Written
approval from the property owner (or authorized agent) of the utility poles or
street light standards to be used for the display of decorative banners shall be
required as a condition to the approval of the sign program. Decorative banners
shall not identify any individual business or tenant name and shall not contain
written advertising copy. Decorative banners may be located no lower than
fourteen (14) feet above grade and must enhance the subject commercial or
industrial district such that the colors, logos, materials and design of the
decorative banners are appropriate to the district in which the decorative banners
are to be installed."
SECTION IV.
Should any section, subsection, clause, or provision of this Ordinance for any reason be
held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the
validity or constitutionality of the remaining portions of this Ordinance; it being hereby expressly
declared that this Ordinance, and each section, subsection, sentence, clause and phrase hereof
would have been prepared, proposed, approved and ratified irrespective of the fact that anyone
or more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
SECTION IV.
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after this Ordinance's passage in a
newspaper of general circulation, published, and circulated in the City of Orange. The City
Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting for and against the
Ordinance in accordance with Government Code Section 36933. This Ordinance shall take
effect thirty (30) days from and after the: date of its final passage.
